FoI/2016/724

Dear Ms Giggins,

Request for information: Correspondence/representations regarding FOI
2016/407

Please see below the Council’s response to your request for information.

You have asked for all correspondence, representations and advice held by
the Council regarding the response to your previous FoI request (ref
number FoI/2016/407) in which you requested the minutes of the Planning
Policy Task Group.

I believe that the purpose of this request is purely personal and intended
only to attempt to prove the Council’s wrong doing in the handling of your
request and therefore, does not reflect matters of wider public interest.
Public interest in the Planning Policy Task Group Minutes has been served
by the publication of these minutes on the FoI disclosure log.

It is hard to see the value or public interest in devoting any further
resources to this request.

Therefore,  due to the context and history in which this request was made,
we are refusing to supply any information in response on the grounds that
Section 14(1) (Vexatious requests) of the Freedom of Information Act 2000
applies.

If you are unhappy with the way your request has been handled, you may ask
for an internal review. You should contact David Lowe, Scrutiny &
Partnerships Manager, Strategic Support, Council Offices, Market Street,
Newbury RG14 5LD, email [1][email address]  if you wish to
request a review. If you are not content with the outcome of the internal
review, you have the right to apply directly to the Information
Commissioner for a decision. The Information Commissioner can be contacted
at:

Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow,
Cheshire SK9 5AF

If you have any queries about this letter, please contact me.

Yours sincerely,

The FOI referred to in my original request can be found here:

https://www.whatdotheyknow.com/request/m...

It is currently under internal review as the disclosures on the FOI log have (a) been unnecessarily redacted and (b) are not complete.

Edit: Should read The FOI referred to in this request....

Dear West Berkshire Council,

Please pass this on to the person who conducts Freedom of Information reviews, unless involved with the original decision, in which case please refer to a senior officer versed in FOI.

I am writing to request an internal review of West Berkshire Council's handling of my FOI request 'Correspondence/representations regarding FOI 2016/407'.

I don't believe Miss Kenchington has applied the 'vexatious' guidance correctly. There would be very little burden involved in publishing the representations which I presume are already held by the FOI department, and there is a clear public interest in demonstrating that EIR and FOI policy and procedures are well understood and adhered to by both Council Officers and Councillors.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/c...
