Council (ACC) has completed the necessary search for the information
requested.
Please provide detail of correspondence from members of Legal and
Democratic Services and members of Kingswells Community Council in the
period from July 1st 2017 to date (August 25th, 2017).
Please see below details of correspondence:
Email received and responded to on 24 August from one member of Kingswells
Community Council.
Email sent on 24 August to one member of Kingswells Community Council
advising Community Council Liaison Officer (CCLO) would call after
meeting.
Emails issued to CCLO on 24 August from 2 members of Kingswells Community
Council relating to letter they received.
Email issued to all Community Councils including members of Kingswells
Community Council on 24 August relating to In Town Without my Car day
asking for volunteers.
A letter was drafted and issued to all Community Council members dated 22
August 2017. The letter contained information relating to breaches
against the Scheme for the Establishment of Community Councils in a few
areas.
Email issued to all Community Councils including Kingswells Community
Council on 22 August attaching the agenda for Communities, Housing and
Infrastructure Committee.
Email issued to all Community Councils including Kingswells Community
Council on 17 August in relation to the EcoCity Awards.
Email issued to all Community Councils including Kingswells Community
Council on 17 August in relation to the Contact Centre Consultation.
Email issued to all Community Councils including Kingswells Community
Council on 11 August in relation to First Aid Training.
Email issued to all statutory consultees in regards to the proposed
Aberdeen Football Club stadium on 26 July. A response was received on 2
August advising that Kingswells Community Council wished to participate at
the hearing.
Email issued to all Community Councils including Kingswells Community
Council on 5 July relating to playpark updates.
Email issued to all Community Councils including Kingswells Community
Council on 5 July relating to Strategic Car Parking Review.
Email issued to all Community Councils including Kingswells Community
Council on 3 July relating to the Climate Change Bill.
Please also provide details of any complaints received in relation to
Kingswells Community Council for the same period (July 1st 2017 to August
25th, 2017).
According to our records in the requested period, the Council received 4
emails and 13 phone calls in relation to complaints made against
Kingswells Community Council. The nature of all complaints was that they
had submitted an objection to the Kingsford Stadium Application without
seeking the views of the community.
Please provide full details of how any complaints were investigated and
supply any detailed report produced as a result of any investigation by an
officer of the council.
On receiving the complaints the Council considered information on the
Kingswells Community Council website

Following the investigation, the Council issued a letter to the Community
Council regarding the conditions set out within the Scheme for the
Establishment of Community Councils in relation to seeking the views of
the community.

ACC are unable to provide you with some emails as they contain, in their
entirety, personal information about third parties and is exempt from
disclosure. In order to comply with its obligations under the terms of
Section 16 of the FOISA, ACC hereby gives notice that we are refusing your
request under the terms of Section 38(1)(b) in conjunction with
38(2)(a)(i) – Personal Information - of the FOISA.
Also, please note that third party names and personal details, as well as
the names of ACC Officers who are below Head of Service level have been
redacted (blacked out) from the attached documents as it is exempt from
disclosure under the Freedom of Information (Scotland) Act 2002. In order
to comply with its obligations under the terms of Section 16 of the FOISA,
ACC hereby gives notice that we are refusing your request under the terms
of Section 38(1)(b) in conjunction with 38(2)(a)(i) – Personal Information
- of the FOISA.
In making this decision ACC considered the following points:
ACC is of the opinion that Section 38(1)(b) applies to the information
specified above as any information held is personal information relating
to living individuals, of which the applicant is not the data subject.
ACC is of the opinion that Section 38(2)(a)(i) applies, as we consider
that disclosure of this information would be a breach of the first Data
Protection Principle (that personal information must be processed fairly
and lawfully). These individuals have not consented to the disclosure of
their information, and ACC does not consider that they would expect ACC to
release this information about them into the public domain under the
FOISA.
