Dear Aberdeen City Council,

I would be grateful if you could supply me with copies of all information you hold regarding engagement with ADES on the subject of the school starting age or deferral to starting school since July 2018. This should include, but not be limited to, advice and reports from ADES; agendas, minutes and papers of any meetings at which either or both of these issues were discussed; emails or other correspondence between the local authority and ADES.

Secondly, please can you advise if and how the council uses SIMD data in making discretionary deferral funding decisions.

Dear Ms Anderson,

 

Thank you for your information request of 2 March 2020.  Aberdeen City
Council (ACC) has completed the necessary search for the information
requested. Our response is now detailed below.

 

I would be grateful if you could supply me with copies of all information
you hold regarding engagement with ADES on the subject of the school
starting age or deferral to starting school since July 2018. This should
include, but not be limited to, advice and reports from ADES; agendas,
minutes and papers of any meetings at which either or both of these issues
were discussed; emails or other correspondence between the local authority
and ADES.

We have reviewed all correspondence we hold regarding engagement with ADES
on the subject of the school starting age or deferral to starting school
since July 2018 as requested.  We attach the following:

 

 1. ADES Pre-Fives Sub Committee – Guidance on Deferrals to Primary School
Education 2001 (attached to email 17/10/2018)
 2. Deferring Entry to Primary School – CoSLA / ADES Short Life Working
Group (16/09/2019)
 3. Email from ADES (02/10/2019)
 4. Correspondence from CoSLA to ADES Early Years Network (received
11/12/2019)

 

We can also advise that ADES maintain a website and some information is
available to view such as Minutes of Meetings.  See

Please note that we have redacted (blacked/whited out) third party names
and personal details, as well as the names of ACC Officers who are below
Chief Officer as it is exempt from disclosure.  In order to comply with
its obligations under the terms of Section 16 of the FOISA, we hereby give
notice that we are refusing this part of your request under the terms of
Section 38(1)(b) in conjunction with Section 38(2A)(a) – Personal
Information - of the FOISA.

 

We are of the opinion that Section 38(1)(b) applies to the information
specified above as the information in question is personal information
relating to living individuals, of which the applicant is not the data
subject. 

 

We are of the opinion that Section 38(2A)(a) applies, as we consider that
disclosure of this information would be a breach of the ‘lawfulness,
fairness and transparency’ principle.  These individuals have not
consented to the disclosure of information that could allow them to be
identified, and we do not consider that they would expect us to release
this information about them into the public domain under the FOISA.

 

Secondly, please can you advise if and how the council uses SIMD data in
making discretionary deferral funding decisions.

SIMD data is not used in making deferral funding decisions.  Decisions are
made by a multi-agency panel based on the information in the Deferred
Entry Application, which focus on needs of the child.
