Thank you for your FOI request, your request has been allocated the above

Early indications while collating information relating to your FOI request
show your request will likely exceed the fees limit of 18 hours.  It is
therefore highly probable the Council will be contacting you again in the
next 7 days to discuss reducing the scope of your request, to one which
the Council will be able to respond to within the fees limit.
 Alternatively if you are happy to be charged for any additional hours,
please let me know and we will prepare a fees notice for the additional

Good afternoon Mr Seamark.

 

Following our recent email to you dated 17 November, the Council has now
finished its initial assessment of the information held within the
Council’s systems relating to your FOI request. I am writing to formally
advise you that the time required to fully respond to your request in its
current format will exceed the Appropriate Limit and Fees Regulations of
18 hours. The Council is therefore refusing to prepare this information
for release. 

 

However, the Council is prepared to review this decision if you could
significantly reduce the scope of your request to one which could be
completed within the fees limit; for example, the Council could consider
looking at one single topic or a single service area. Please be aware
information relating to ongoing complaints such as those within planning
enforcement or section 106 agreement are likely to be exempt from
disclosure as these case files are ongoing. 

 

Your request has now been placed on hold for a period of 20 working days.
If the Council does not receive clarification from you within this period
your request will be closed.

Thank you for your email narrowing the time period of your request to
correspondence from June 8^th 2020. Unfortunately this would only remove
approximately 20% of the emails collated in our initial assessment phase
of your request so does not reduce the scope of the request enough for the
Council to be able to consider responding within the fees limit.

 

The Council is therefore asking you to consider further reducing the scope
of your request, such as restricting to a sub topic thread or department
(bearing in mind information relating to ongoing complaints such as those
within planning enforcement or section 106 agreement are likely to be
exempt from disclosure as these case files are ongoing).

If not, it might be helpful if you suggested a percentage of the emails that would be acceptable for a single request.

If it also helps (because you've mentioned it twice now) I do not need to see any communication relating to ongoing complaints the council feel they have not yet responded to adequately.

Good afternoon Mr Seamark

 

Please accept the Council's apologies for the delay in responding to you. 
It was hoped that we would be in a position to advise you of our progress
in evaluating your FOI request following your last suggested reduced date
period, before the Christmas break but the assessment phase of the vast
number of emails made this target impossible to complete along with the
usual pre Christmas break rush to clear work. 

 

After refining the initial email searches to your revised date parameters
and removing email thread duplication the Council has reduced the scope to
one which it is now prepared to respond to although it still exceeds the
18hrs threshold. This is because the Council accepts there is public
interest in the way the Council has enforced the planning conditions on
the site with local residents. The Council is now taking your request off
of hold and will begin preparing its response covering the dates 29th July
2020 to 13th Nov 2020.  

 

Please note that responding to this shortened request will still exceed
the fees limit in its own right. The Council will not therefore be
accepting any further requests for similar information or additional date
ranges from you or any other individual or group unless it can be shown
there is significant wider public interest in a particular issue relating
to the site. The Council considers that the disclosure of the information
as proposed will be sufficient to satisfy the public interest
accountability arguments contained within the legislation which additional
date ranges will not significantly add to. In addition, as your request is
being made via the whatdotheyknow website the Council’s response will be
publicly available for all with an interest to view, (with of course
personal data such as names and email address suitably removed to comply
with data protection legislation).

 

Due to the large amount of work that is required to prepare the request
for disclosure such as personal data redaction, the Council is applying an
extension of 20 working days to complete this work.  The Council will
therefore provide you with your response by 16 February at the latest.
