I am currently reviewing your request and investigating whether there is
any information available for disclosure.  The Council, in accordance with
Section 10 of the Freedom of Information Act 2000 (‘the Act’), will reply
to your request promptly and in any event not later than the twentieth
working day following the date of receipt. Subject Access Requests will be
responded to within one calendar month in line with the GDPR (General Data
Protection Regulation).

 

In accordance with section 8(1)(b) of the Act and related guidance from

Information Request:  FOI 14338

 

I refer to your information request dated 24 August 2021 received in our
office yesterday.

 

On 10 September 2020, your planning team was sent a Permitted Development
notification letter by Jacobs, agents acting on Highways England's behalf,
regarding HGG2/1 - a disused railway bridge in Barcombe - and their
intention to infill it.

 

Could you please provide me with all correspondence and documentation
exchanged with Jacobs or Highways England about this structure and its
proposed infilling?

I have carefully reviewed your request and investigated whether there is
any information disclosable to you. Unfortunately, the council is not able
to give you the information because it considers it is exempt from
disclosure. I have set out the reasons for this decision below.

 

The Council considers this request to be exempt under Section 14 (1) of
the Freedom of Information Act 2000 [The Act].  This section states that
the Act “does not oblige a public authority to comply with a request for
information if the request is considered to be vexatious or repetitious”.

 

This request is identical to the one you submitted on 20 March 2021 (FOI
13292) and to which we replied on 14 April 2021. I attach a copy of that
reply for your convenience.

 

All applicants have a 'right to review'.  A review should be focused on
the original request and should identify how the council’s response failed
to answer your Information Request.  Reviews must be made in writing (or
e-mail) within 40 working days of receipt of this response and addressed
to the Information Governance Reviews Officer, to the address below.

My new request covers a different time period to the one submitted on 20 March. I have been told by a local that there have been discussions between the Council and Jacobs/Highways England about this project and the request is intended to capture any emails sent/received over the intervening 22 weeks.

Please reconsider it on that basis.

information the council holds, and which I am pleased to provide to you.

 

I have 17 documents which comprise the total documentation held by the
council in relation to this development which I will send in subsequent

documents please let me know and I shall look at alternative formats.
