I write with regard to your request dated 17 July 2016 (received by us on
18 July 2016) and your further email of 21 August 2016 (which was received
by the council on 22 August 2016).

 

From our preliminary assessment we estimate that the costs of answering
your request would exceed the cost limit of £450.00 set under Section 12
of the Freedom of Information Act 2000 to locate, retrieve and extract the
information.  There are three sub-departments found under strategic
development and we therefore anticipate that there will be substantial
correspondence between these and English Heritage/Historic England on a
variety of subjects including listed buildings, scheduled monuments etc. 

It is therefore not possible to supply the information you have
requested.  It may, however, be possible to provide you with information
if you were to specify which building or scheduled monument you wished to
receive information about.  Please could you direct your response to

I refer to your request under the Freedom of Information Act 2000 dated
17 July 2016 (received 18 July 2016) and clarified by you on 27 September
2016. Your request has been dealt with under the Environmental Information
Regulation 2004 as these are the most appropriate legislation relating to
your request.

 

I set out below in italics your requests with the council’s response
below.

 

“...please supply me with copies of all correspondence between Shepway

letters, details of phone calls, invoices, statements, reports, meetings
and anything to do with planning/development. from January 2015 to
present.”

 

“...The land I am interested in, is known as Princes Parade.”

 

We do not hold any correspondence with English Heritage in respect of
Princes Parade.  In respect of the correspondence with Historic England
the council has decided to refuse your request on the ground of the
exception contained in regulation 12(5)(e) - confidentiality of commercial
or industrial information where such confidentiality is provided by law to
protect a legitimate economic interest.  In this case the legitimate
economic interest is that of the council.  Disclosure of the confidential
information would adversely this interest.  In applying this exception the
council has carried out a public interest test and concluded that the
public interests in withholding the information outweigh the public
interest in disclosure.
