OSPT KILO,

Dear Chris,

It is not clear what you are asking. Please clarify if you would like general advice from the Official Solicitor or anything specific to his role.

Section 8 of the FOIA requires that a requester should provide a name within their request. Can I ask that you provide your full name please.

Kind regards
OSPT KILO

Dear OSPT KILO,

Thank your for a speedy response.

I appreciate the sensitive nature of the duties of the Official Solicitor and undertakers. However, this is just an information request. I am not interested in any legal advice and am requesting the information for personal interest research purposes. These are particularly related to property legislations from 1925 and the Senior Courts.

In regards to my full name it would help if you could define legislation or other laws that classify the meaning of name, as I feel the name I have given is sufficient and has been sufficient for other FOI requests to bodies of government. To add to this, this is a public website and for my own protection do not feel committable disclosing personal information such as my full name.

In relation to my questions it may help if I rephrase them for your comprehension, as I am not asking the official solicitor in the capacities where they would be a discharge of his functions.

1) It is my understanding that there is a variety of bodies that are corporation soles. Is their any legislation that enables a person natural or other to create a corporation sole? Such as, can a British Citizen legal or lawfully create a corporation sole?

2) The term "hereditament" is frequently used in the Law of property act 1925, Settled Land Act 1925, trustees Act 1925 and the Administration of Estates act 1925. There appears to be a common definition of the term "hereditament" between those statutes however in other acts it can be defined differently. As Office Holder of the Senior Courts I thought it may be appropriate to request; what is the definition or interpretation of "hereditament" used in the Senior Courts?

Due to your response I have some further enquiries could you please explain the term you used "quasi-corporation" in the context you used it above?

Could you also please elaborate on the meaning of "last resort" in the context you used it above?

Again I can only apologise if there was an air of confusion in my initial request, I hope this further clarifies my intent and enables us to carry these requests and enquiries further.

Many Thanks

chris

OSPT KILO,

Chris,

Sorry for the delay in responding to your email. I was awaiting responses from internal colleagues with respect to your query.

I have checked internally and I have been advised that the information you have requested is not readily available and it would need a lawyer to look at it in more detail. Doing so would constitute legal advice which this office does not provide to members of the public.

The last resort policy is an acceptance criteria for the Official Solicitor to act as administrator of estates or as trustee. You can find more information about the Official Solicitor or the Public Trustee through the link below:
