I wonder why the authority has failed to respond...

Could it be possible that there is something in the report they do not want to reveal? Are there aspects of the investigator's findings they have chosen to ignore?

If there is nothing to hide, perhaps the authority would like to explain why they have neither responded, nor excused the delay in so doing.

A request for review would be the next stage in the process, but as such a request is unlikely to result in any useful disclosure, it would seem to be another case for the ICO.

How interesting that the authority has responded to Mr Janik's similar FOI by refusing to comply with the DPA due to the intemperate manner of his request.

Despite being urgently overdue they have not replied to this one at all. Why would that be?

I suggest Mr Janik and Mr Khan let the ICO know the authority is unlawfully withholding information.

As all of us flew over Burnham Beeches and the surrounding areas, we saw and smelled a big bonfire in the back garden of a council person close to the old Commonwealth Agricultural Bureau which once accommodated a discreet office for an intelligence agency. My nosey husband swooped low and said he saw papers marked football, Montem, Arvato, racecourse, Bath Road pizza.

Council tenants are entitled to know the findings of the investigation, recommendations and action taken to improve service.

FREEDOM OF INFORMATION REQUEST

Please accept my apologies for the delay in responding. Your FOI request has been considered and I have been asked to respond as follows:

Section 1 of the DPA defines personal data as data which relates to a living individual, who can be identified:
• from that data, or
• from that data and other information which is in the possession of, or is likely to come into the possession of, the data controller.

When a public authority receives a request for information that constitutes personal data about living individuals, it must decide whether disclosure would breach Principle 1 of the Data Protection Act (the DPA), i.e. whether it would be fair and lawful to disclose the information.

Whether the disclosure is fair will depend on a number of factors including:
• Whether it is sensitive personal data;
• The consequences of disclosure;
• The reasonable expectations of the individuals; and
• The balance between any legitimate public interest in disclosure and the rights and freedoms of the individuals concerned.

Information held by the council about employees will relate to them as an individual and to their personal situation and in these circumstances there is a greater expectation that a public authority would not disclose such information.

The FOIA section 40(2) provides an exemption when the requester is asking for someone else’s personal data – in this case personal data relating to the public authority’s former and current employees. This is an absolute exemption and unlike qualified exemptions it does not require a public interest test.

Having considered your request I can confirm that although Slough Borough Council holds information that falls within the scope of your request, the council is relying on section 40(2) (personal information) to withhold this data. It is the councils view that information contained within the report is the personal data of the individuals either mentioned within the report, or those who contributed to the report. It is also the view of the council that even with redaction anyone with even a basic understanding of the council could identify individuals.

Therefore to release this information would put the council in breach of the first principle of the Data Protection Act 1998 (DPA).

I concur absolutely; my husband's and my sentiment precisely. Our lovely neighbours the Frogs agree; so does everyone on our lake and on the surrounding land.

Mrs Owl told Mrs Frog that things will only improve at that human controlled muddle if wiser and clever folks like us take-over. My eldest says Mrs Owl must have seen the staff reorganisation consultation that floated along the river this week.

I think our prime minister has more pressing matters to attend at the moment. Nevertheless, I agree that some kind of government intervention is necessary.

The investigation, which was commissioned by the strategic director following serious complaints from the public and members of staff, highlighted significant failings in the housing service, most of which have not been resolved.

Many of the complainants have since been bullied out of the council. Those that are left are afraid to speak out for fear of repercussions.

It is a serious scandal.

The waste of money resulting from incompetence at a high level and the abuses of the housing revenue account are matters of public interest, but don't expect any kind of transparency from this authority. They have far too much to hide.
