Thank you for your request for information dated 18 July 2017, which has
been dealt with under the Environmental Information Regulations (EIR)
2004.
 
You have request the agricultural holding number for a specified address
and the date it was last used. You have also asked for a copy of the
lands, buildings and activities associated with the agricultural holding
number.
 
The RPA can confirm that the County Parish Holding (CPH) number is
45/084/0082; it was closed on our Cattle Tracing System in 1998. We do not
hold any further information about when the CPH number was last used.
 
We will not be able to answer your last question without further
clarification. Regulation 9 of the EIR requires public authorities to
provide advice and assistance to applicants where reasonable.
 
The RPA is a paying Agency, delivering the Rural Development Programme,
and the EU Common Agricultural Policy Payments (CAP) to farmers and
traders in England. We are also responsible for the management of the
British Cattle Movement System (BCMS) and the Land Management System which
captures the parcels of land registered under CAP. As such we only hold
information in relation to these activities.
 
We can search our records to identify what information is held in
connection to these activities. In order to do so we would require a date
range for your request e.g. 2015-16 and a map of the area or a Google map
image with the field outline in red, so that we can identify the land in
question.
 
Once we have received the above information, we will be able to proceed
with your request and advise whether we can provide the information.
Please note that the 20 working day timescale for responding to your
request will commence from the date that we receive the clarification.
 
If you are not happy with the way we have handled your request, you can
ask for an internal review. These requests should be submitted in writing
within two months of the date of receipt of the response to your original

Thank you for your request for information dated 21 July 2017, which is
being dealt with under the Environmental Information Regulations (EIR)
2004.
 
You have asked whether payments of grants and subsides have been made on a
specified holding and whether cattle or livestock were kept on it between
2000 and 2014.
 
In accordance with Regulation 13(5)(a) of the EIR we neither confirm nor
deny whether the information such as that specified in your request exists
and is held by the RPA. The giving to a member of the public of such
confirmation or denial would breach one or more of the data protection
principles.
 
Section 1 (1) of The Data Protection Act (DPA) 1998 defines personal data
as follows:
 
"personal data" means data relating to a living individual who is or can
be identified either from the data or from the data in conjunction with
other information that is in, or is likely to come into, the possession of
the data controller;”
 
Under Regulation 13(5)(a) of the EIR we may respond to a request by
neither confirming nor denying whether such information exists and is held
by us, whether or not we actually hold such information, to the extent
that the giving to a member of the public of the confirmation or denial
would breach any of the data protection principles.
 
The First Data Protection Principle (as set out in Schedule 1 to the DPA
1988) states:
 
“Personal data should be processed fairly and lawfully and in particular
shall not be processed unless at least one of the conditions in Schedule 2
is met…”
 
We consider that the only condition in Schedule 2 which could have any
relevance is condition 6 which states:
 
“The processing is necessary for the purposes of legitimate interests
pursued by the data controller or by the third party or parties to whom
the data are disclosed, except where the processing is unwarranted in any
particular case by reason of prejudice to the rights and freedoms or
legitimate interests of the data subject”
 
In this context, the legitimate interests of a third party are held to be
the legitimate interests of the public at large rather than a particular
individual. As there is insufficient general public interest in the level
of detail you are requesting we can neither confirm nor deny whether the
information exists and is held by us, or whether or not we actually hold
such information.
 
If you are not happy with the way we have handled your request, you can
ask for an internal review. These requests should be submitted in writing
within two months of the date of receipt of the response to your original

RPA to undertake an internal review into how your request for information
number RFI 4566, raised under the Environmental Information Regulations
(EIRs) 2004, was handled. The question raised in your original request
was:

Matters Considered by the Internal Review
 
The review has found that the RPA based its rejection under Regulation
13(5)(a) of the EIRs; in that an authority may refuse to disclose
environmental information if an exception applies. In this instance the
relevant exception is based on information which may belong to a third
party which does not meet the ‘Public Interest’ test on disclosure.
 
Under Regulation 13(5)(a) of the EIR we may respond to a request by
neither confirming nor denying whether such information exists and is held
by us, whether or not we actually hold such information, to the extent
that the giving to a member of the public of the confirmation or denial
would breach any of the data protection principles.
In Schedule 2 which could have any relevance is condition 6 which states:
“The processing is necessary for the purposes of legitimate interests
pursued by the data controller or by the third party or parties to whom
the data are disclosed, except where the processing is unwarranted in any
particular case by reason of prejudice to the rights and freedoms or
legitimate interests of the data subject”

The review also considered the legislative timeline for completion of the
initial request and
found that the response was acknowledged and issued within the preliminary
timeframe
(21^st July – 3^rd August 2017).
 
Outcome of the Internal Review
 
In order to satisfy itself that the use of the exception was appropriate,
the review looked at how the RPA’s response made use of Regulation
13(5)(a).
 
Before claiming this exception the RPA completed an appraisal of the
request. In its response dated 3^rd August 2017 the RPA explained its
position to the effect they could neither confirm nor deny any activity
concerning the RPA and the holding number in question during the time
period requested.
 
The review then reviewed a recent decision from the Information
Commissioners Office (ICO) regarding the application of EIR Regulation
13(5)(a), and decided that, based on the recent guidance, the RPA should
make a limited disclosure of information relating to the appeal.
 

 1. We can confirm that RPA does not hold any data on mapping associated
with the holding number on its systems. Therefore the information is
not held.

 

 2. The word ‘Activity’ has been interpreted as meaning: interactions
between the holder of the agricultural holding number and the RPA
regarding claims and payments during the period 2000-2014.

 
The RPA is mindful of protecting the personal information of the holder of
the agricultural holding number in regard to regulation 12(3) - When
information is the personal data of someone other than the applicant,
regulation 12(3) requires the RPA not to disclose that personal data,
except in accordance with regulation 13. Regulation 13 prohibits the RPA
from disclosing third party personal data if this would breach the Data
Protection Act.
 
However, the RPA can confirm that it holds records of claims made by the
holder of the agricultural holding number for the period of 2000 to 2004.
No other ‘activity’ data exists for the period 2000 - 2014.

the right to apply directly to the Information Commissioner for a
