Controlled Drinking Zones

Please could you provide me with a copy of all the Designated Public Place Orders made by your authority under sections 12 to 16 of the Police and Criminal Justice Act 2001 and which are currently in force, together with a copy of any maps which show the extent of the the area covered by each order?

Thank you for your recent request, received 23rd July 2008, concerning
designated public place orders.

Your request is being considered and you will receive a response within the
statutory timescale of 20 working days, subject to the application of any
exemptions. Where consideration is being given to exemptions the 20 working
day timescale may be extended to a period considered reasonable depending on
the nature and circumstances of your request. In such cases you will be
notified and, where possible, a revised time-scale will be indicated. In all
cases we shall attempt to deal with your request at the earliest
opportunity.

There may be a fee payable for the retrieval, collation and provision of the
information requested where the request exceeds the statutory limit or where
disbursements exceed £10. In such cases you will be informed in writing and
your request will be suspended until we receive payment from you or your
request is modified and/or reduced.
Your request may require either full or partial transfer to another public
authority. You will be informed if your request is transferred.
If we are unable to provide you with the information requested we will
notify you of this together with the reason(s) why and details of how you
may appeal (if appropriate).

Depending on the nature of your request, there is a possibility that the
information held (if any) by Lewisham Council is governed by the Data
Protection Act 1998 or Environmental Information Regulation. Should this be
the case, we will inform you of the situation and issue you the necessary
forms and guidance in order for you to proceed with your search.

Further to your email, received on 23 July, concerning Designated Public
Place Orders (DPPO) made by Lewisham Council, we are pleased to provide
the requested information.

I passed your request onto Khurram Shaikh (Community Safety Team Manager),
who provided the following response:
The Criminal Justice and Police Act (CJPA) 2001 gave local authorities the
power to designate public areas through the introduction of a DPPO where
it is an offence to drink alcohol after being required by a police officer
not to do so. The police have the power to require individuals to
surrender the alcohol and any opened or sealed containers. If the
individuals fail to comply with the request they can be arrested. The
powers - which replaced the old drinking byelaws - were introduced to help
the police deal with the problems of anti-social drinking in the public
space. DPPOs make it easier for local authorities to designate places
where restrictions on public drinking will apply and can be used in areas
that have experienced alcohol-related disorder or nuisance.

As far as I am aware there are two such orders within Lewisham:
1 Lewisham Drinking Control Zone which extends along Lewisham High
Street from Lewisham Central to Catford.
2 Upper Brockley Road Drinking Control Zone - implemented on the 19
April 2008
