Contractual terms of reference for Selected Medical Practitioner

Dear Avon and Somerset Constabulary,

Dr Philip Arthur Johnson was appointed to the role of selected medical practitioner (SMP) for Avon and Somerset Constabulary recently.

1. Please tell me the date when he was appointed.

2. Please tell me the date he commenced his duties.

Note: Dr Johnson is director of a company, Sarum Occupational Health Ltd, of 35 Chequers Court, Brown Street, Salisbury, Wiltshire, SP1 2AS. If the appointment was of the company rather than the named individual, please treat this request as for information concerning the company's appointment and commencement of duties.

3.Please provide to me a copy of that part of the contract which fully details and defines the role of the SMP in the above appointment with regard to the reviews of degree of disability, including both party’s obligations and responsibilities and the manner and extent of communication prescribed between each party for the purpose of such reviews.

4. Please tell me if Dr Philip Johnson or Sarum Occupational Health Ltd are on the list of SMP's produced by the National Attendance Management Forum.

Specifically you asked: Dr Philip Arthur Johnson was appointed to the role

recently.

 

Q1. Please tell me the date when he was appointed. 

 

Dr Johnson was not appointed but was nominated.

 

Q2. Please tell me the date he commenced his duties.

 

Dr Johnson commenced his duties on 24^th July 2014.

 

Q3.Please provide to me a copy of that part of the contract which fully
details and defines the role of the SMP in the above appointment with
regard to the reviews of degree of disability, including both party’s
obligations and responsibilities and the manner and extent of
communication prescribed between each party for the purpose of such
reviews.

 

Dr Johnson is an independent Doctor and is not employed by the
Constabulary on a contract.

 

Q4. Please tell me if Dr Philip Johnson or Sarum Occupational Health Ltd
are on the list of SMP's produced by the National Attendance Management
Forum.  

 

Dr Johnson is not on the list. However, this is not a mandatory list.
Forces are able to select SMPs not listed.

Dear #Freedom of Information Requests,

So dr johnson is working pro-bono. And independent doctors do not require contracts ? Even general practitioners have contracts although they are self-employed.

I am rather concerned that you have engaged the services of an independent medical practitioner but you have not in any way determined the contractual requirements of that role. Hours, work location, expenses etc are obviously not a concern of the force.

There is no going back. Although i guess you are not being truthful i am not going to pursue this. I have an answer that i am satisfied with. You cannot say there is a contract of any sort later, now you have denied its existence on a freedom of information request.
