Dear Mr. Swift,

Thank you for your below email.

To advise, however, the only current contract Leeds City Council has with
Balfour Beatty concerns Phase 1 and 2 of the East Leeds Orbital Route, and
we are not aware of Balfour Beatty pursuing third party drivers for damage
to Crown Property on this contract.

Given the above, could you perhaps provide specific clarification on as to

Dear Mr. Swift,

To advise, this particular project is at a very early stage, however, if there was to be damage to street furniture, this matter would be addressed by Leeds City Council. There is no schedule of charges held by the Council in this regard.

I trust that this response is satisfactory. Under Regulation 11, however, you are entitled to make representations to us if it appears that we have failed to comply with a requirement of the Regulations in relation to your request. Representations must be made to us no later than 40 working days after the date you believe we failed to comply with such a requirement.

We will then consider your representations and supporting evidence and decide if we have complied, notifying you of our decision as soon as possible, and no later than 40 working days after the date of receipt of your representations.

Under Regulation 18, you are then entitled to apply to the Information Commissioner for a decision as to whether, in any specified respect, your request has not been dealt with in accordance with parts 2 and 3 of the Regulations.

Should you wish to contact the Commissioner’s Office then you can write to the following address: Office of the Information Commissioner, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF.

You may also contact the Commissioner via his website at www.ico.gov.uk

I trust that this is self-explanatory. If you have any queries please contact me on 0113 3787100, or by return email.

Dear Leeds City Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Leeds City Council's handling of my FOI request 'Contract With Balfour Beatty – TP Claims & Costs'.

Following damage to street furniture, whilst this matter my be addressed by Leeds City Council, I understand Balfour Beatty will undertake reinstatement. To this end there will be charges raised. It matters not who undertakes recovery, at some stage there would be an approach and necessarily the sum claimed would be broken down, priced and need to justified.

If these costs are unavailable, when will they be provided.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/c...

Dear Mr. Swift,

As this appears to be asking a different question to your previous request, I do not consider that it would be appropriate to consider this matter as an appeal. To clarify, however, is your query that, hypothetically, if Balfour Beatty put highways infrastructure in place, and this was then damaged, who would replace this infrastructure and how would this replacement by charged for?

Dear IMG.CC.requests,

You have stated:
‘this particular project is at a very early stage, however, if there was to be damage to street furniture, this matter would be addressed by Leeds City Council. There is no schedule of charges held by the Council in this regard.’
I have asked:
‘with regard to Balfour Beatty's contract whether or not this involved a joint venture (j/v):
1. Is (or was) it Balfour Beatty (or the j/v) that pursued Third Party Drivers for damage to Crown Property; street furniture, such as barriers, signs and the road surface
2. what is / was the basis of Balfour Beatty (or the j/v) charging you for damage to Crown Property
3. what is / was the basis of Balfour Beatty (or the j/v) their charging Third Parties for road works following damage to crown property
I am seeking:
4. the means by which the schedule of charges is compiled and whether they differ at '2' and '3' above.
5. The rates charged to the council and TP's and make up during the contract period for:
a. An Operative - road worker
b. a 2.5T van
c. 7 an 18T TM Rig
6. The last complete Balfour Beatty or j/v schedule of rates for operatives, plant and materials’
I clarified:
Following damage to street furniture, whilst this matter may be addressed by Leeds City Council, I understand Balfour Beatty will undertake reinstatement. To this end there will be charges raised. It matters not who undertakes recovery, at some stage there would be an approach and necessarily the sum claimed would be broken down, priced and need to justified.
If these costs are unavailable, when will they be provided.
You have yet to address the original request. Your responses appear intended to avoid the issue, obstructive.
If Balfour Beatty undertake reinstatement, there would be a schedule of charges for the works. It is unclear whether you are saying that Balfour Beatty do not undertake the works by Leeds City Council do so using their own stat and not Balfour Beatty.
I have no concern as to who put highways infrastructure in place. My request clearly relates to damage to the ‘infrastructure’ (‘street furniture’ or ‘Crown Property’); if the this was then damaged,

Someone would replace this infrastructure. Someone would raise a charge for doing so; who and how would this replacement be charged for?

Yours sincerely,

Mr P Swift

Dear Leeds City Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Leeds City Council's handling of my FOI request 'Contract With Balfour Beatty – TP Claims & Costs'.

You have not addressed the request.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/c...

IMG.CC.requests, Leeds City Council

Dear Mr. Swift,

I write in response to your below email of 15th October and have addressed your queries below:

1. Is (or was) it Balfour Beatty (or the j/v) that pursued Third Party Drivers for damage to Crown Property; street furniture, such as barriers, signs and the road surface

No. The Council would do this.

2. what is / was the basis of Balfour Beatty (or the j/v) charging you for damage to Crown Property

Balfour Beatty would charge the actual cost of replacement. This would be determined at the point of replacement (there is no specific schedule).

3. what is / was the basis of Balfour Beatty (or the j/v) their charging Third Parties for road works following damage to crown property I am seeking:

N/A.

4. the means by which the schedule of charges is compiled and whether they differ at '2' and '3' above.

Please see the response to question 2).

5. The rates charged to the council and TP's and make up during the contract period for:
a. An Operative - road worker
b. a 2.5T van
c. 7 an 18T TM Rig

N/A.

6. The last complete Balfour Beatty or j/v schedule of rates for operatives, plant and materials’

N/A.

I clarified:

It matters not who undertakes recovery, at some stage there would be an approach and necessarily the sum claimed would be broken down, priced and need to justified. If these costs are unavailable, when will they be provided.

As stated above, the charge would be the actual cost of the reinstatement works.

If Balfour Beatty undertake reinstatement, there would be a schedule of charges for the works. It is unclear whether you are saying that Balfour Beatty do not undertake the works by Leeds City Council do so using their own stat and not Balfour Beatty.

These charges would be detailed at the point the reinstatement was undertaken and would be specific to that work. There is no pre-set charge schedule.
