Dear City Building (Glasgow) LLP,

Request under the Freedom of a Information (Scotland) Act

Following the recent change of ownership that has occurred within City Building (whereby the second share held indirectly by Glasgow City Council through GCC LLP Investments Limited has been replaced by Wheatley Housing Group Limited), I should like to understand the organisation's plans for complying with FoISA and EIR requests going forward.

Accordingly, could you please disclose the following:

1) Wheatley Housing Group / GHA are not currently covered by FoISA, however, typically voluntarily comply with requests. As CBG were previously wholly owned by a public authority, and therefore, covered under the Acts, can you please confirm what the organisation' policy on Freedom of Information is as of the ownership change? Has any notification or otherwise been made to OSIC?

2) Please disclose any relevant sections of the contract between CBG (whether directly or under the auspices of one of the Council entities) and Wheatley which cover FOI / Information disclosure.

3a) Please confirm the ownership status going forward of City Building (Contracts) LLP and City Building (Glasgow) LLP. I understand from Companies House that Wheatley are now a designated member in the latter, however, it is unclear to what extent this is - I.e. To give an example, whether any profits generated are returned to both LLP members, or only one (as is the case with another one of the Council's LLP companies, Service Glasgow LLP).

3b) As regards the Contracts entity - can you confirm if ownership is indeed wholly retained by the Council or has been divided in similar terms?

I can appreciate some of this information may have elements that you would deem to be commercially sensitive, however, I am sure you will recognise the strong public interest in ensuring transparency owing to the significant change in ownership which has a long term impact on public finances (and ultimately the jobs of several thousand employees).
