Dear Information Commissioner's Office,

I would be grateful to know how many times within the last year the Information Commissioner's Office has received complaints about the Financial Ombudsman Service failing to respond to Freedom of Information Requests within the stipulated time period regarding the Royal Bank of Scotland Group of companies and what, if anything, you have done to ensure that this practice is stopped.

This is of course related to my recent complaint to you about just such a practice.

We are now in a position to provide you with a response to your
information request sent via the WhatDoTheyKnow.com website on 27 January.
 
Your Request
 
“I would be grateful to know how many times within the last year the
Information Commissioner's Office has received complaints about the
Financial Ombudsman Service failing to respond to Freedom of Information
Requests within the stipulated time period regarding the Royal Bank of
Scotland Group of companies and what, if anything, you have done to ensure
that this practice is stopped. This is of course related to my recent
complaint to you about just such a practice”
 
We have dealt with your request in accordance with your ‘right to know’
under section 1(1) of the Freedom of Information Act 2000 (FOIA), which
entitles you to be provided with any information ‘held’ by a public
authority, unless an appropriate exemption applies.
 
Our Response
 
I can confirm we hold information that falls in the scope of your request.
Please find attached a table of the freedom of information complaints that
we have received with a submitted about party of Financial Ombudsman
Service (FOS) in the last year, 27 January 2019 to 27 January 2020. Only
one case relates to an information request to FOS regarding the Royal Bank
of Scotland group. The FOI technical breach column refers to the section
of FOIA the complaint relates to. DN stands for Decision Notice.
 
Please note that the information provided in the table reflects the data
on the date it was extracted from our casework management system and can
be subject to change over time. For example, some of these complaint cases
have yet to be concluded.  
 
If we decide to take regulatory action against an organisation it will be

However, if you are dissatisfied with your request for information under
FOI and wish to request a review of our decision or make a complaint about
how your request has been handled you should write to the Information

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response. Any such request received
after this time will only be considered at the discretion of the
Commissioner.
