On 22 January 2018, the Public Services Ombudsman for Wales received the following request for information:
Please could you provide for the period of the last 24 months;
The full copies of reports against the Welsh Ambulance Service where the complaint was upheld in full or part made under Section 21 of the Public Services Ombudsman (Wales) Act 2005.
The copies of reports for the same period where the complaint was not upheld against the Welsh Ambulance Service.
Response
Your request has been considered under the provisions of the Freedom of Information Act 2000 (FOI Act). Please note, section 84 of the FOI Act states "information...means information recorded in any form"; we have therefore considered whether we hold recorded information in relation to your request. When responding to requests for information, we must ensure compliance with the requirements of our governing legislation, the Public Services Ombudsman (Wales) Act 2005 [PSOW Act]. In particular, the PSOW Act restricts the disclosure of reports issued by this office. In view of this restriction, we therefore consider that reports in question are exempt from disclosure under section 44 of the FOI Act:
"(1) Information is exempt information if its disclosure (otherwise than under this Act) by the public authority holding it -
(a) is prohibited by or under any enactment."
However, you may wish to note that the PSOW does produce a summary of each upheld and not upheld report issued by this office. These summaries can be found in The Ombudsman's Casebook, which is available under the 'Publications' page of our website, which can be searched by keyword - for example, Welsh Ambulance Services NHS Trust.
