Dear Mr Killip

Further to your request for information under the Freedom of Information
Act 2000 (FOIA) of 8 May 2013, please see requested information below. I
have used the same format as your request.

 1. The Information Commissioner’s Office (ICO) has received 18 requests
for assessment against Thomas Cook from May 2011 to present day. Our
reporting tool is only able to report on the last two years and as you
did not request the information for a specific period, we have
provided information for that entire timescale.
 
 2. You have asked how many of these complaints were upheld and not
upheld. Firstly, I must explain that the way in which the ICO handles
complaints under the Data Protection Act 1998 (DPA) differs to the
handling of FOIA, due to the format of the legislation.

Under the DPA, an individual, known as a data subject, has the right to
make a subject access request (a request for copies of the data held
relating to them) to any authority/company that holds his/her personal
information. If the data subject is not satisfied with the handling of the
request, he/she may make a request for assessment to the ICO.
At that point, the ICO will review the handling of the subject access
request and will then give an opinion as to whether we consider that
compliance with the DPA is likely or unlikely.

In response to your request, therefore, of the 18 cases referred to above:
 

 1. 0 cases were assessed as compliance likely
 2. 11 cases were assessed as compliance unlikely

You will note that there are 7 cases not accounted for above. In some
cases, it is not possible to reach such a conclusion, if for example,
there is not enough evidence or the provisions of the DPA have not been
met.

I have attached a document containing definitions to assist you in
understanding the information provided.

No information has been withheld in relation to your request.
