Further to the above FOI request I am required under the legislation to state that I wish to register a formal complaint regarding the reply received from a member of your staff, who has failed to follow the legislation set-out regarding FOI requests. To this end I require an internal review of this ignorant reply. I suggest that this member of staff has not followed your 'self-reported' SPELL guidelines regarding this FOI reply and that this should form part of the complaint, as the recipient is fully minded when it comes to my particular disability but chooses to act in a prejudicial, offensive manner.

The following questions were supplied to Enfield Social services I have included the replies, which are unsatisfactory. Please submit for an internal review.

This member of staff undermines her own argument (suggesting she has no idea what an adult autism assessment is or was) by referring to 'Care and Support Act Assessments'. However, she continued in her ignorant and self-defeating vein, to further abuse the FOI system, by disingenuously suggesting that she has no idea what I am referring to.

Further failure is evidenced by the statement, that a diagnosis is the same as an assessment and that perhaps this is 'something for the NHS'. I do question the integrity & professionalism of your staff, but this is an example on another level of council arrogance coupled with laziness.

Because of this staff member's intransigence and lack of respect for herself or the public to which she serves, I find myself having ask the same questions again, albeit with a subtle nuance (that is the change from ADULT AUTISM ASSESSMENTS to CARE & SUPPORT ACT ASSESSMENTS).

Can you explain why it has not been possible to find a suitably qualified member of staff at Enfield to carry out the Care and Support Act assessment?

Given that I have had TWO UNLAWFUL Care and Support Act assessments for my Autism, how do I go about getting a LAWFUL Care and Support Act assessment with the correctly qualified staff?

Do you have or have you ever had at any point the staff to undertake Care and Support Act assessments lawfully? If not why not?

Will you be writing to all those who have had UNLAWFUL Care and Support Act assessments and offering them LAWFUL ones to offset your malfeasance ? If not why not?

Will you be contacting Public Health England and reporting the obvious failing of the Autism strategy? Or will you continue to mislead this organisation with false "SELF-REPORTED"statements about staff being trained in NAS SPELL, when there are no staff trained in SPELL (see National Autistic Society SPELL guidance) and that this is a mere aspiration? (For background see Public Health England Autism Self Assessment Enfield - It is so full of lies as to be a complete fallacy).

NB If there are any problems with interpreting the words contained within this letter - please do not hesitate to first consult a dictionary as I obviously have malicious and malevolent intent and would chose to hide this in florid and colourful language designed to obfuscate and confuse the intended recipient.
Secondly, it would have been a more professional and honest approach to have contacted me avoiding the ignorance and confusion of this staff member, who has chosen to "reply" to the questions disingenuously.

I am writing further to your email dated 16 April 2015 in which you
request an internal review of the Council’s response to your above Freedom
of Information request.

The scope of the internal review is limited to the handling and also the
substance of the response to your original request for information. The
internal review is now complete and I am in a position to advise you of
the outcome.

 

I have reviewed the responses that were provided and my findings are as
follows.

 

1.  Between March 2012 and current date, how many ADULT AUTISM ASSESSMENTS
have been carried out by Enfield?

The  response provided was:

 

·         Autism assessments are carried out by the NHS instead of the
Council. Therefore, we do not hold this information.

In the course of this Internal Review I have checked with the teams
working in the relevant department and referred to the Enfield Joint
Commissioning Strategy for Adults with Autism 2013-2018.  The question may
have appeared ambiguous to the reader if you were referring to a
diagnostic assessment or a community care assessment. Diagnostic
assessments are carries out by the NHS CCG so it was correct to say we do
not hold this information. However, I feel we could have sought
clarification on the question and for this I apologise on behalf of the
Council.

Section 3 and section 4 of the

reference to the demands on the service and market analysis.

 

 

2. How many of these assessments were LAWFUL and how many were UNLAWFUL?

 

The response provided was:

·         N/A

 

I apologise for the abbreviated reply which I take to mean Not Applicable.
I am unable to determine the validity of any assessment which is outside
of my expertise and without the knowledge and outcome of each case I am
unable to source this information. We do not hold a central point of
information to answer this question.

3. Could you set out your specific criteria for deciding the legality of
the assessment showing which legislation you have followed (Autism Act;
National Assistance Act or National Health Service and Community Care Act
).

 

The response provided was:

which legislation to apply. Our failure to seek clarification for question
one has led to a situation where it was not possible to provide a
meaningful answer.

SPELL guidelines the you claim you follow?

The response provided was:

 

·         The Council does not undertake autism assessments, rather these
are carried out by the NHS.

 

Again I find that this question directly relates to question one. If the
question was regarding a diagnostic assessment then the information
provided was correct. I find that our failure to seek clarification
undermined provision of the answer. I apologise for our failure to seek
clarification on the question.

 

5. Can you explain why it has not been possible to find a suitably
qualified member of staff at Enfield to carry out the assessment?

 

The response provided was:

 

·         The Council does not undertake autism assessments as noted
above. Just to clarify, Care and Support Act assessments are carried out
by the Council and support is provided, as appropriate to service users
who meet the eligibility criteria.

 

The response was correct based on the assumption that we had interpreted
that you were referring to a diagnostic assessment. A community care
assessment would come through our customer pathway by either a GP referral
or self-referral. As mentioned above we should have sought clarification
from you on the previous questions and in particular this question. If you
are referring to your personal circumstances and/or any other individual
this information would be covered by the Data Protection Act. If you are
seeking information about yourself you would need to make a subject access
request.

 

6. Given that I have had TWO UNLAWFUL assessments for my Autism, how do I
go about getting a LAWFUL assessment with the correctly qualified staff?

 

The response provided was:

 

·         Issues relating to autism assessments have been covered
previously. Should you wish to discuss this further, please contact your
GP who will take the appropriate action.

 

When we replied it is evident that we assumed you were referring to a
diagnostic assessment which would be carried out by the NHS. I apologise
for not seeking clarification with you in order to best answer your
question. If you are seeking personal information that the council hold on
you in this regard, you will need to make subject assess request under the
Data Protection Act.

7. Do you have or have you ever had at any point the staff to assess
lawfully? If not why not?

 

The response provided was:

 

·         Please note that the Council does not assess for autism as
mentioned previously.

 

The Council would not intentionally commit an unlawful act and staff are
trained for their particular roles. As the question is unclear we should
have sought further clarification from you. If this is related to your
previous question, you will need to make a subject access request.

 

8. Will you be writing to all those who have had UNLAWFUL assessments and
offering them LAWFUL ones to offset your malfeasance ? If not why not?

 

The response provided was:

 

·         I am unable to comment as the Council does not carry out autism
assessments.

 

I was unable to find any source of information or central recording of
information that would answer your question. If individuals were not
satisfied with their assessments it would be recorded on personal files
and subject to the Data Protection Act.

9. Will you be contacting Public Health England and reporting the obvious
failing of the Autism strategy? Or will you continue to mislead to this
organisation?

 

The response provided was:

 

·         I am not aware that the Council feel that there is any need to
contact Public Health England at this time.

 

 

An example of the  Autism Spectrum Condition Adult Care Pathway is set out
in Appendix 7 of the Enfield Joint Commissioning Strategy for Adults with
Autism 2013-2018,

The responses I have provided above conclude your requested review and the
Council process in respect of your Freedom of Information request is now
exhausted.
