The response to my enquiry has been delayed - I was initially told that by law I should have received a reply by 8th February, as it was submitted on 12th January - or according to Council responses, by 11th February. Please accept my apologies for the delay in responding. Unfortunately I cannot indicate when the response will be provided to you. The relevant service areas are still trying to quantify the amount of recorded information held. Only then will I be able to calculate what fees may be chargeable and whether your request would be considered an EIRs Extended request which could extend the due date.

I should advise that you have a right to seek a review at this stage as we have failed to meet the statutory deadline of 11/2/2019 but you cannot seek a further review if you are subsequently dissatisfied with the information provided following the review process.

I shall continue to chase the service areas causing the delay.

Subject: SportScotland Communications - Meadowbank Stadium

Thank you for your request for information of 14/01/2019 where you asked the following;

I request details of all correspondence and meetings, from 1/1/2013 to the present date, with SportScotland; concerning the proposed closure, redevelopment or future use of any part of the entire Meadowbank Stadium site including the stadium & sports centre, velodrome, car park and landscaped areas.

The above should include dates, times, agendas, names of attendees, notes, minutes, emails and other correspondence (redacted as appropriate).

It should also cover all meetings, including those held by Councillors, Council officials and/or anyone representing the City of Edinburgh Council at such a meeting.

Your request for information has been processed under the Environmental Information (Scotland) Regulations 2004 (EIRs). Please accept my apologies for the significant delay in identifying recorded information which is within scope of your request and for failing to keep you updated.

Under regulation 8 of the EIRs, public authorities can make a charge for providing Information. We have calculated that in this case the total cost of complying with your request is £75.00.

This sum has been calculated as follows:

Having completed all relevant searches we have established that there is no information held by Members' Services in relation to any of our councillors. The information which was held in archives for the former Sport and Culture Division is not within the date range of your request. We have identified 52 e-mail chains from 2017 onwards which are within scope of your request. It took approximately one hour to locate and retrieve this information. Allowing 5 minutes per e-mail chain to prepare these for release so that the Data Protection Act 2018 is not breached and that information which is not within scope or is repeated is removed would equate to a further four hours of work.

Estimated number of records to be located, retrieved and provided - 52 e-mail chains.

Number of staff hours involved - 5 hours (5 minutes x 52 e-mail chains +1 hour)

Charge per hour - £15.00

Total - £75.00

If you wish to proceed with this information request, please confirm in writing to the address noted below or to [Edinburgh City Council request email], providing your postal address if you have not already done so. An invoice will then be issued to you and must be paid upon receipt. Alternatively, you may notify this office in writing that you no longer wish to proceed with the request.

I am writing to request an internal review of City of Edinburgh Council's handling of my FOI request 'Communications between CEC and SportScotland concerning Meadowbank Stadium'.

I am requesting a review due to the following circumstances:

1) Failure to respond within timescale required by legislation
Your response dated 21 March stated "it took approximately one hour to locate and retrieve this information" so why did it take two months to do this, and why was it not possible to issue this response within the 20 working days' limit? And why does the 21 March response state "20 working days' limit is suspended" when it has already been significantly exceeded?
2) Failure to keep me updated with progress - please explain why I was not kept updated
3) Failure to process this request under the FOI Act. Please explain why you have chosen to interpret this request under the Environmental Information (Scotland) Regulations 2004 Act rather than under Freedom of Information legislation, which might have resulted in the information being provided without cost?

Additionally, I would like to know what "portion of information" you would be prepared to supply without charge?
