"We have now compared the replacement response with that originally supplied by the council.

The name, email address and physical address of one person who had commented on a planning application was released in the first instance but redacted in the replacement. That probably was personal information which the council should not have released via Freedom of Information, particularly in light of what the council say to those commenting on planning applications about publication of their personal information at https://www.southwark.gov.uk/planning-an...

The majority of the new redactions were to remove the names and contact details of those working for the developers, including very senior individuals at those companies. Much of the redacted material is available online, for example via:

The council's statement saying about 20 names were removed is of about the right order of magnitude.

A couple of council officers' names, roles and contact information were removed too.

While reading the response we noticed that it reports on another Data Protection Breach. Page 26 of the document released at:

states that students' personal data, including access card numbers, were accidentally included as part of the planning application materials and were placed online by the council.

I am writing to request an internal review of Southwark Borough Council's handling of my FOI request 'Communications and meeting with Delancey January - July 2018'.

You state that personal information of 'third party individuals' was redacted in accordance with Regulation 12(3) of the Environmental Information Regulations (EIR) 2004. It is difficult to understand why names of staff at DP9, Delancey, Carvil Ventures etc would have been redacted as not only are many already in public domain on the companies' respective websites, but the companies involved are council's partners in this development, ie not 'third party'. In addition, redacting names of developer staff while disclosing personal details of people who commented on the planning application and UAL students makes it even more difficult to understand.

The request was for records of communications as well as minutes of meetings between developer and council officers and/or councillors. While the response you provided makes numerous references to numerous meetings between the council and developer, no minutes of any of them were provided. Considering the importance and impact of this development, full disclosure is very much in public interest.

INTERNAL REVIEW OF THE HANDLING OF YOUR FREEDOM OF INFORMATION REQUEST

Apologies for the delay in responding to your request on the 30 October
where you requested that we carry out an internal review to our original
response to you.

“I am writing to request an internal review of Southwark Borough Council's

Before addressing the internal review we would just like to correct
inaccuracies in your statement above. We can confirm that the developer
Delancey and their consultants such as DP9 and Carvil Ventures are not
council partners in this development. The council has no commercial or
landholding interest either in the shopping centre or the London College
of Communications. The involvement of Southwark Council is as the planning
authority for what is a private development.   

In addition you are aware that the personal details of people who
commented on the planning application and UAL students were released in
error as stated 3 October on the What-do-they-know.com website. This was
as a result of a complaint from Delancey which stated that:  

‘the names, addresses and telephone numbers of PA’s have been released in
the information this morning and they are incredibly concerned about it
and want those documents to be taken off immediately so that they can be
redacted.  Can you please let me know when you pick up this email?’

On investigation we determined that multiple accounts of personal data had
been sent out un-redacted which included:

• Name of planning officers – below director level (already in the
public domain on planning application)
• Name of objector
• Address of objector
• Email address of objector
• Names and telephone numbers of personal assistants at Delancey
• Names, email addresses and telephone numbers of staff at Delancey
• Names, email addresses and telephone numbers of staff at DP9
• Signature of consultee from Historic England
• Job title of officer from Southwark Law
• Name, job title, telephone number of staff at GIA

The data breach was reported to the ICO and we are awaiting their
response.

I have gone through all the information subsequently released and believe
that the council has applied redactions to the information we hold
correctly. It is not the role of the council to check whether or not 3^rd
party information is already available in the public domain, just that
information held by the council is treated in compliance with the EIR
regulations.

Regarding your point that “While the response you provided makes numerous
references to numerous meetings between the council and developer, no
minutes of any of them were provided.” I can confirm having checked with
the officers and management involved in these meetings that the council
hold no minutes of these meeting. If Delancey or any of their consultants
produced minutes, they were not shared with the Council.
