Thank you for your email below, which has been passed to the Legal Aid Agency ('LAA', an Executive Agency of the Ministry of Justice).

It may assist if I explain that the Freedom of Information Act (at section 84) covers 'recorded information' held by public authorities. As your enquiry is not a request for the disclosure of recorded information but a general question about the operation and function of the LAA, I am replying to your query outside the scope of the FOIA.

The LAA funds legal representation for eligible parties, subject to the law of England and Wales. Cases being dealt with under other legal jurisdictions (such as Scots law or the law of Northern Ireland) fall within the remit of equivalent Authorities (for example the Scottish Legal Aid Board, or the Legal Services Agency Northern Ireland).

The scope of the legal aid scheme for England and Wales is set out in the Legal Aid, Sentencing and Punishment of Offenders Act 2012, which is available to view at www.legislation.gov.uk.

Dear Information Governance (LAA),

Thank you for your reply, but with respect my request relates (I believe) to recorded information. I am not interested in legalities as they have no relevance in a Common Law Jurisdiction. I think you will record what cases you deal with so what I require of you is to tell me if there are any common law cases there. You only need to find one to be able to say yes.

I would appreciate it to be treated as an FOI request, but I do thank you for your initial response.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Legal Aid Agency's handling of my FOI request 'Common Law'.

You said " I mentioned in my email of 3 February 2017, the LAA deals with cases according to the
law of England and Wales (as per section 32 of the LASPO Act). Information about the LAA
is available at https://www.gov.uk/government/organisati.... You
have asked about which of these cases relate to 'common law'. Given your comments on
'legalities' I am unclear on what definition of 'common law' it is your intention to use, however
in any event this is not something that the LAA records, as there is no legal or business
reason for us to record such information. "

You clearly don't deal with cases according to the law as the law of the land is common law and the LASPO act is statute law. Am I to take it you don't deal with common law?
