Dear Department for Exiting the European Union,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Exiting the European Union's handling of my FOI request 'Committee on Exiting the European Union evidence session briefings'.

In refusing my request for information, you state: "There is a strong public interest in withholding the briefing documents created by Civil Servants to brief Ministers and the Permanent Secretary so as to preserve the safe space needed to consider all relevant questions and areas of discussion put forward by the Select Committee. If colleagues had to operate under the assumption that all advice and discussion would be conducted in full public view, the advice would inevitably be more reserved, arguments be less balanced and the necessary deliberations significantly curtailed, thus critically diminishing the quality of our briefings and preparations for select committee appearances."

Briefings for select committee appearances must necessarily deal with matters that could legitimately be brought up in questioning during the session. It therefore follows that the content of the briefing is inarguably a matter of public interest but also that its release was judged a possibility during the normal democratic scrutiny of government and should be disclosed upon request.
