We confirm that we hold the information that you have requested.

Response: We apologise that we are unable to provide this information as
this aspect of your request is still being processed. We will endeavour to
provide a response to you as soon as possible and thank you for your
patience in this matter.
2. Actual spend on this contract/framework (and any sub lots), from the
start of the contract to the current date
Response: £461,245.32

3. Start date & duration of framework

Response: Contract Award 03 Dec 2018 Start date 17 Dec 2018, duration 3
years with option to extend by a further 2 years.
4. Is there an extension clause in the framework(s)/contract(s) and, if
so, the duration of the extension?  Or may prevent them coming out for
re-tender and what the level of spend has been on during the current
framework period?
Response: Yes, there is a 2 year extension clause in the contract. The
spend amount is answered in question 2.
5. Has a decision been made yet on whether the framework(s)/contract(s)
are being either extended or renewed?
Response: A decision has not yet been made as to whether the contract will
be extended or not, this will be discussed in the coming months.

6. Who is the senior officer (outside of procurement) responsible for this
contract?
Response:  The Deputy Technical Services Manager (acting Technical
Services Manager) is the officer responsible for the coastal zone
maintenance contract.
If you are unhappy with the way your enquiry has been dealt with, you may

Further to our response of 07/05/2021, we are now able to provide the
outstanding response to your request.

We apologise for the delay in our response to your request.

Our response:
1. Suppliers who applied for inclusion on each framework/contract and were
successful & not successful at the PQQ & ITT stages

Response: This is not a framework contract, it is a Term Service contract
procuring one contractor for all works included in the contract
specification. All evaluation was completed. Only one contractor was
successful - “Ovenden Allworks Ltd”. Details of the successful bidder are

Regarding the remainder of your request, we confirm that we hold this
information however the Council considers that the details of unsuccessful
suppliers is exempt from disclosure under Section 43(2) 'commercial
interests' and Section 41 'information given in confidence' of the Freedom
of Information Act 2000 (FOIA).

Section 43(2) of the FOIA states that information is exempt if its
disclosure would, or would be likely to, prejudice the commercial
interests of any legal person (including the public authority holding it).
Disclosure would be likely to prejudice the competitive procurement
process of the Council and those of the unsuccessful bidders in that
information is provided on a competitive basis to secure a contract.
Disclosing that information is likely to prejudice both the commercial
interest of the unsuccessful bidders and the commercial interest of the
Council in that it may deter companies from bidding in future. This in
turn could impact the Council's ability to ensure value for money in its
procurement processes.

Section 41 (1) Information is exempt information if – (a) it was obtained
by  the  public authority from any other person (including another public
authority), and  (b) the disclosure of the information to the public
(otherwise than under this  Act) would constitute a breach of confidence
actionable by that or any other person. This information was provided for
the purpose of a confidential procurement exercise and unsuccessful
parties would not expect this information to be publicly disclosed.

In applying these exemptions, the Council has considered the public
interest test and it's duty of openness and transparency. However, we
recognise and consider that there is a greater public interest in
maintaining confidentiality and protecting commercially sensitive
information. The Council considers that it would be unreasonable to
release this information into the public domain.

ask for an internal review by submitting a request within one month of the
date of this response.
