Closure of Footpath

Dear Sir or Madam,
Why is the footpath linking Western Road and Farman Street closed. An order of closure was issued as building work was being done on the adjacent property No. 5/6 Western Road Hove. The order expired in December 2008. It has never been renewed.
This work was the result of an Enforcement Notice issued to the owner by Brighton & Hove City Council. The required work is now three months over the date set for completion. Little or no further work is being done. Why are the Council not taking action against the building owners? We want our footpath opened up to the PUBLIC.

I have received the following FOI request foi/225/09. We need to respond
to this by 19 May 2009. We only need to respond with information that
we hold, we do not have to create or analyse information. The request is
as follows:

"Dear Sir or Madam, Why is the footpath linking Western Road and

Farman Street closed. An order of closure was issued as building

work was being done on the adjacent property No. 5/6 Western Road

Hove. The order expired in December 2008. It has never been

renewed. This work was the result of an Enforcement Notice issued

on charging i.e. what we can charge for. Consideration should also be
given to whether the resources required to respond to this request exceed
the upper limit. The request would then be exempt and we would not then
be required to respond.

"A Council representative has spoken with the builder this afternoon
(Friday 8 May) who has given assurance that the pathway will be open by
end of next week albeit not full width as there is brick surfacing to take
place."
