Cleveland Police PFI Sub-Contractor's "Commercially Confident" Polices

Dear Home Office,

I write to you now under the Freedom of Information Act.

This video is recorded evidence of telephone conversations with Cleveland Police Professional Standards Department and its PFI subcontractor Tascor Detention & Medical Services at the offices of Tascor Detention Centre Management, Tascor Nurses Office at Cleveland Police and to Operations Management at Tascor Medical Services Headquarters.

The evidence concludes the concession of all parties involved that a "Commercially Confidential" Policy implemented by the private PFI subcontractor in question is in place at Cleveland Police that supposedly allows for the mistreatment of detainees by means of torture and inhumane & degrading treatment in direct contradiction of the rights set out in the European Convention on Human Rights Article 3 and Police Codes of Practice Code C and its respective Act.

All parties involved in the video have either confirmed that the policy is held in complete secrecy or that due to it being a policy of a private company the policy requested is "Commercially Confidential" and therefore not available to the public, despite it directly affecting the welfare of said public and it clearly causing torture and inhumane treatment to detainees by refusing them any medical treatment or assistance for six hours or more.

I am sure the Home Office would agree that a private company acting on behalf of a public services contract could not implement a secret policy as part of that services contract, that negatively affected the welfare of detainees through mistreatment, and refuse to make said policy public.

Equally, it is acceptable to presume that the responsible signatory to the contract for subcontracting services to private companies (in this case the Office of the Police & Crime Commissioner for Cleveland) would have a fine understanding of the operational procedures and policies implemented by their subcontracted private agent before signing any contract that could lead to professional negligence by way of ignorance.

However the policy, created and implemented by Tascor Services at Cleveland Police detention centres that apparently allows for detainees to be refused legally prescribed medication for six hours or more in contravention of basic human rights, is supposedly completely unobtainable by the Office of the Police & Crime Commissioner for Cleveland despite being the lead-contractor ultimately overseeing Tascor Services. With this in mind, please could I request from the Home Office a copy of the supposedly "Commercially Confidential" policy implemented by Tascor Services Ltd whilst carrying out their contract for Cleveland Police, on behalf of the Police & Crime Commissioner for Cleveland, that allows them to violate the ECHR Article 3, the Codes of Practice Code C, PACE Act, Equality Act & Human Rights Act by means of torture, inhumane treatment & degradation and injury through denial of legally prescribed and life-requiring medication as evidenced in this recording?

Please note we are not requesting the policy regarding controlled substances & illegal drugs; the audio recording already confirms a distinction that they are two separate policies.

If the information is not held by the Home Office could you kindly either refer this request to the appropriate body who does hold said information or advise me of who that might be so that I may put it to them myself?
