Clean Bill of Health - Contamination and Flooding of Building Land

Dear Calderdale Metropolitan Borough Council,

Subject: Clean Bill of Health - Contamination and Flooding of Building Land

1) I understand that development / conversion of Thorpe Mill, Triangle (Post Code HX6 3DA) into Apartments started about 13 years ago and that Calderdale Council granted permission for this subject to the developer producing independent evidence that the ground on which Thorpe Mill stands and the surrounding area were not contaminated by chemicals used during the Mill's working life, or, if it was contaminated, remedial action would be / has been taken to alleviate this condition. Please confirm my information is correct and provide documentary evidence to show these environmental contamination concerns were addressed satisfactorily before Calderdale Council gave the go-ahead for the development.

2) I also understand that the Trucking Company next door to Thorpe Mill at THORPE GARAGE, I believe owned by Claude Hellowell Trucking has built their Warehousing Complex on this land which was previously a Waste Disposal site. Please confirm this and advise if this was only a sorting area for waste disposal or a landfill site and what environmental contamination checks were made prior to Calderdale Council giving permission for the warehouse development (IE: Was the area given a clean bill of health prior to commencement of the warehouse development). Please provide documentary evidence of this.

3) What is the Flood Risk rating for the Thorpe Mill Court development and when was the last serious flood at this building, where the building was actually flooded?

4) Have any flood risk prevention measures been undertaken for Thorpe Mill Court and if so, please provide details.

5) Barkisland Mill at Post Code HX4 0HG is likely to have had similar issues to Thorpe Mill Court. Please provide documents to show any ground contamination concerns at the mill and in the immediate surrounding area and a clean bill of health to those concerns before Calderdale Council gave permission for development into apartments. Also advise the Flood Risk Rating for this mill conversion and when was the last serious flood at this building, where the building was actually flooded? Finally, please confirm if any flood risk prevention measures have been undertaken.

Dear Janet Morris,

Whilst the information provided on Barkisland Mill was very useful, that provided for Thorpe Mill was not really satisfactory for the following reasons -

You reference Condition 13 regarding possible environmental contamination (This condition refers to the type of windows to be used) I was referring to Condition 11 which remains unanswered.The reference of the document which I have and which I downloaded from CCC website, is 92/1169 Re: Planning Permission to J.Smith and Co. (No date shown, but I can e-mail you the applicable document if you wish, providing you send me your e-mail address).

I have since withdrawn from a prospective purchase of a property at Thorpe Mill as a result of my solicitor and myself being unable to get to the bottom of this contamination issue, but would be interested in finding out if Condition 11 was ever answered satisfactorily before conversion of Thorpe Mill into apartments was undertaken, since this was a condition of the permission being given.
