Please send me a breakdown of the receipts for CIL paid to the District Council (minus the amounts paid to Parish and Town Councils) by financial years for

developments across the District
developments in the parish of Southwell

and the expenditure for these receipts by the District and County Councils in these same years

across the District ( with their appropriate name for the 123 list)
and in the parish of Southwell ( again the name from the 123 list)

Dear Sir/Madam,

Your request for information was received by us on 18/Mar/2019. Our
initial assessment of your request is that the information in question, if
it is held by the council, may fall within the scope of the Freedom of
Information Act 2000. A further assessment will be made once we have
located any relevant information held by the council.

Under the provisions of the Freedom of Information Act 2000, we will
respond to your request promptly, but in any case within 20 working days
following the date that we received it. This means that you will receive a
response from the Council on or before 15/Apr/2019.

For your information, the Act defines a number of exemptions, which may
prevent release of some or all of the information you have requested.
There will be an assessment of the information available and if any of the
exemption categories apply the information may not be released. In the
case of a qualified exemption the Public Interest Test will be considered.
You will be informed if any of the information held is subject to any
exemption and if so reason the exemption has been applied and of your
rights of appeal.

If the information you request contains reference to a third party they
may be consulted prior to a decision being taken on whether or not to
release the information to you. You will be informed if this is the case.

If you have asked for any information to be provided in a specific format
we will do our best to do so. However if it is not practicable or it is
unreasonable to do so, any information will be provided in Adobe Acrobat
pdf.

Should you require the information to be provided other than by email a
fee may be payable in respect of disbursements, you will be informed if
this is the case. In this event the fee must be paid before the
information is processed and released. The 20 working day time limit for
responses is suspended until receipt of the payment.

Dear Newark and Sherwood District Council,

This spreadsheet appears misleading. I have asked how much of the CIL received from developments in Southwell have been spent in Southwell. Although you show spending of receipts from Southwell, there have been no List 123 spending allocated in Southwell, so the spreadsheet must be spending of the Southwell receipts elsewhere in the District.

Please can you reply to me request showing clearly

receipts from developments across the District
receipts from developments in the parish of Southwell

and the expenditure for these receipts by the District and County Councils in these same years
across the District ( with their appropriate name for the 123 list)
and in the parish of Southwell (again the name from the 123 list)

Following further discussions with our Financial Services and Planning Development Business Units, I have been asked to provide the information in the attached spreadsheet

There has been no List 123 expenditure and regrettably the previous tables were incorrectly labelled. The table headings should have been ‘amount received’ and ‘amount remaining’, the amount remaining column is a sum of the amount received less the administrative fee and the meaningful proportion. The administrative fee can be up to 5% of the receipt but depends upon the costs incurred in the collection of CIL..

Than you for a more helpful report. However, I did request details of the List 123 expenditure across the district from the expenditure shown. Whilst I now see that no List 123 has been allocated to Southwell, please can you tell me what the expenditure has been on in the other parts of the District?

Under the Freedom of Information Act, an internal review relates to the information provided or a decision to refuse some or part of the request . In this instance we did not refuse your request but your email of 10th April asked for a review on the basis that the information provided appeared to be misleading.

On 18th April we sent a revised spreadsheet with a further explanation of this information and on 23 April I confirmed that there had been no List 123 expenditure..

On this basis I believe that the Council had provided all of the information requested and I am unsure as to what further information you are now requesting. If you could clarify I will of course look into this for you.
