I am writing to request an internal review of Children and Family Court Advisory Support Service's handling of my FOI request 'CIAF : Experts research/feedback'.

1. You have provided an attachment of a list of library sources which avoids the request for CAFCASS to provide the

From the judiciary, academics and therapists involved in the consultation of the CIAF

2. It is a requirement of GDPR to say whether you do or do not hold the information requested therefore can you be accurate do CAFCASS hold the information I have requested

3. There is strong basis for appeal with VERY strong PUBLIC INTEREST in disclosing the information for the following reasons:

a. Transparency: Sarah Parsons publicly said that CAFCASS wanted to be ‘ABSOLUTELY TRANSPARENT’ about any framework CAFCASS were rolling out therefore it would be accurate for CAFCASS to honour Ms Parsons declaration otherwise it could then be said Ms Parsons provided the public with inaccurate information. You have given no real reason to with hold information.
b. Accountability: No remit has been provided to CAFCASS since 2015 from the Secretary of State therefore any changes in CAFCASS policy should be fully transparent in the public domain
c. Good decision making: it is completely in the public interest to disclose this information so that the public can have confidence that rational decisions were made and that these decisions were procedurally fair and not intended to have a negative impact on any groups to include those groups with protected characteristics
d. Ensuring procedural fairness, Equality rights included and EHR considered plus all relevant legislation: CAFCASS provide advice to the judiciary who rely on accurate data therefore it is important for the public to feel confident that the a Judiciary who CAFCASS say have had input have had oversight and CAFCASS have interpreted legal legislation in family law correctly
e. Integrity: it is in the public interest to disclose the information I have requested to avoid any suspicion that CAFCASS have not interpreted legislation that is required for working with children and families incorrectly resulting in adverse negative impacts for the public
f. Justice: to ensure fairness, equality to ensure members of the public are having article 6 EHR act and article 8/abided to it is in the public interests to show ‘experts’ guided CAFCASS accurately and consequently CAFCASS have accurately interpreted and executed current legislation
j. Scrutiny: CAFCASS have already said there has been no external scrutiny from experts in certain areas therefore transparency is in the public interest; there appears to be little parliamentary oversight/scrutiny therefore it is in the public interest to ensure the appropriate experts are providing accurate information to CAFCASS

decision made in the FOI response of CAF 19-156  and requested a review of
the decision.

 

This email serves to acknowledge that your request was received on 17
October 2019 and will be dealt with under the terms of the Freedom of
Information Act 2000.

 

A Senior Officer who was not party to the original decision on whether to
release the information will conduct the internal review. An internal
review involves a review of the decision on disclosure in the original
response and the way in which the request was handled. The internal
reviewer can either uphold or overturn the original decision.

 

Cafcass will notify you as to the final decision made regarding your
internal review 20 working days from receipt of your request.  You will
therefore receive a response on or before 13 November 2019.

Dear Ms Soeder,

 

Thank you for your email.

 

Although two acknowledgements of your Freedom of Information requests were
accidently sent to you using Egress encryption, these were not data
breaches as no personal data was disclosed to any unauthorised individuals
and so these incidents were not reported to the ICO. The acknowledgements
were sent to  the email addresses you had used to make the requests and so
there was no unauthorised disclosure of personal data.

 

We have revoked the emails sent to you via Egress which means that the
emails that were sent to you cannot be accessed. Cafcass are unable to
directly delete information from the Egress platform.  Egress retains
emails for 90 days only, after which they are automatically deleted, as
outlined in [1]Egress Data Retention Policy. We have contacted Egress who
have confirmed that they are unable to delete  an email before the 90
days, however revoking access means no one can access that email, and when
the 90 day period is reached it will be removed by Egress.

I am writing to request an internal review of Children and Family Court Advisory Support Service's handling of my FOI request 'CIAF : Experts research/feedback'.

Included in my rational reasons for internal review please include that I consider exemption of safe space for frank discussions irrelevant and not applicable and should not be applied. The issues the issues discussed were long since discussed and decided upon.

The framework is up and running and CAFCASS should be transparent and the public may draw their own conclusions as to why CAFCASS are preventing disclosure.
