Re: FREEDOM OF INFORMATION (FOI) 2000 ACT RESPONSE

 

I am writing regarding your request for information dated 31^st March 2015
received by this department on 1^st April 2015. I apologise for the delay
in responding.  You have requested a list or an organisational chart,
including the names and job titles of every person that works within the
Council’s Children's Services Department.

 

Please see the attached charts. The names of all officers are held, but
the Council believes that information relating to more junior staff is
exempt under Section 40 (2) of the FOIA as it is the personal data of the
staff concerned.  The exemption is engaged when disclosing the information
would contravene one of the data protection principles in the Data
Protection Act Schedule 1.  The Council deems it to be unfair to disclose
this information unless it relates to senior employees.  It must consider
the legitimate public interest in disclosure and balance this against the
rights of employees.  The interest in disclosure must be a public
interest, not the private interest of the individual requester.  Having
considered all the issues, the Council believes that disclosure of the
details of these officers would not be fair as these are not senior
employees and the information should not be disclosed.

 

The response to your request has been dealt with under the Freedom of
Information Act 2000.
