Child Deaths known to social services - Family Court

The request was refused by Pembrokeshire County Council.

Where up to four children [less than 5] were reported to have died when known to social services between 2003 – 2013 and up to four children [less than 5] between 2013 – 2017.

Could you further clarify and/or provide the following information please?

1. How many of the up to four cases/children [period 2003-2013] were subject to Family Court proceedings?

2. Were the up to four cases in the period 2013 - 2017 also subject to Family Court proceedings?

I am writing to request an internal review of Pembrokeshire Council's handling of my FOI request 'Child Deaths known to social services - Family Court'.

I am somewhat surprised at the response as the subject children are already dead.

I do not see how identifying that any of up to four children in each time period were [or were not] involved in family proceedings can be an issue and not available for disclosure. It is a statistical request/information.

As we have seen with Emily Scully Hicks in Cardiff - she was the subject of family proceedings before her death. Something that was not concealed.

They are too late claiming confidentiality under the Act, they should have done so within 14 day’s of the original request if they wished to claim that exemption, not fallen back on it now

Thank you for your email, the contents of which have been noted.

I can advise that we undertook a review on the 13.12.2017 and the decision was to apply S.41 exemption in this case. As we have already undertaken an internal review I can only re-iterate my previous email below, which is that if you remain dissatisfied with the outcome of the internal review that I politely request you contact the Information Commissioner's Office who details are provided below:

The Information Commissioner is the statutory regulator and an appeal can logged with them directly if you disagree with our decision on review.

Dear Dai Pugh

If the local authority wanted to rely upon a Part II exemption (i.e under s.41) it had to do so within 20 days of the request, not during an internal review.
Under section 17(1) it has a duty to issue the requester with a refusal notice within the time for compliance with section 1(1).
Logically, as the section 41 exemption was first raised after an internal review, the exemption cannot apply.
If those are the circumstances in your case, you need to draw the ICO's attention to them when you complain to him about PCC's response or lack of one.

1. The Council is/was too late in claiming confidentiality under the Act, this should have been done within 14 days of the request if the exemption was to be claimed, and

2. If the Council wished to rely upon a Part II exemption under s.41 it had to do so within 20 days of the request, not during the Internal Review.
