2) How many additional a) registration and b) cautions have been made since October 13 2013?

3) Any information on the total number of claims that have been made by Parochial Church Councils regarding chancel repair a) up to the date of this request and b) since October 13 2013?

Thank you for your email of 7 April 2017 where you requested information
about registrations and cautions that have been made regarding Chancel
Repair Liability.

We are unable to supply all the information requested for the following
reasons:

 

• We did not collect data centrally in respect of chancel repair liability
(CRL) prior to 31 May 2012.

 

• You asked for “the total number of registrations and cautions that have
been made regarding Chancel Repair Liability”. I assume this relates to
titles where an entry has been made as the result of a specific
application for the entry of a notice to protect Chancel Repair Liability
(CRL) on the register. While it may be possible to obtain a report where
there is a standard entry that makes mention of CRL, the list may not
accurately reflect the full position. For example, we couldn’t identify if
the entry arose due to a specific application for a notice or one entered
as part of the normal first registration casework process. To obtain the
information required would involve a bespoke request to our IT department
and additional resource to, check and collate the information. A recent
enquiry with the business development team, to obtain the cost of
supplying such a report for a similar request indicated a cost that would
exceed the £600 FOI limit, in line with section 12 FOI Act.

Section 12 of the Freedom of Information Act makes provision for public
authorities to refuse requests for information where the cost of dealing
with them would exceed the appropriate limit, which for central government
is set at £600. This represents the estimated cost of one person spending
3.5 working days in determining whether the department holds the
information, locating, retrieving and extracting the information.

 

• We do not collect data on any claims made by Parochial Church Councils
in respect of CRL. We only record on the register of a title that a
liability may exist.

 

However, we can provide some limited data from May 2012. This information
relates to applications made for unilateral and agreed notices as well as
cautions against first registration. 

 

1.     Total number of registrations and cautions

From 31 May 2012 to 7 April 2017 we received the following applications in
respect of Chancel Repair Liability:

(a) Unilateral and Agreed notice applications which affected approximately
9574 registered titles.

(b) Approximately 168 Caution applications against First Registration.

 

2.     Registrations and cautions that have been made since 13 October
2013

From 13 October 2013 to 7 April 2017 we received the following
applications in respect of Chancel Repair Liability:

(a) Unilateral and Agreed notice applications affecting approximately 274
registered titles.

(b) Approximately 42 Caution applications against First Registration

 

It should be noted, registered owners remain as free as they were, before
any entry of the notice of claim was made, to challenge such a claim and
we would be unable to confirm that all the notices applied for remain
registered. It may be the case that an entry was made on a title as a
result of an application then subsequently cancelled or withdrawn.  We
would not be able to identify those applications where Notice has been
subsequently cancelled or withdrawn as we do not collect this data. 

 

The data provided has been collected from a variety of sources as part of
the land registration process. Whilst we make every effort to ensure that
the data we provide is as accurate as possible we cannot guarantee it is
fit for your intended purpose or use.

 

It is also subject to Crown copyright and there may be other important
publication restrictions, such as those concerning data protection. This
means that if you intend to publish or quote from the data supplied, you
must let us know in advance of publication.
