Certificates of authorisation for candidates in five wards to be councillor for 2011
Dear Wirral Borough Council,
I am making a request for the certificates of authorisation (part of the nomination papers) of the following candidates in the election for a councillor in the wards below this year. These documents were made available for public inspection and copies by the public between 29th March 2011 and the 6th May 2011.
This includes:-
Certificate of authorisation for the following five candidates.

Good Afternoon,
Thank you for your recent request for information shown below, please see
Councils response below and I hope the information is useful to you.
I am sorry, but on this occasion I am unable to provide a copy of the
information requested. This is because there is no requirement for
Returning Officers to hold copies of certificates of authorisation and
they are not part of the Nomination Papers which are available for public
inspection. Nomination Papers are only able to be inspected from the
close of nominations until the day before the poll. After that time, the
Returning Officer must not allow any person to inspect the Nomination
Papers except for a police officer or a court, which asks to see them as
part of an investigation or part of a court case.

To clarify please could you answer the following questions:-
a) does Wirral Council hold the information requested?
b) what exemption under the FOI legislation are you using?

Good Afternoon,
Thank you for your email below. Apologies, as I have re read my reply and
I may have not made it clear that the Council does not hold this
information. We do not hold it, as we have no legal requirement to do
so. Freedom of Information legislation requires local authorities, in
most cases, to confirm or deny whether they hold the information
requested. As Wirral Council does not hold the information in question,
we do not need to rely on an exemption to refuse disclosure.
