Dear Bolton Metropolitan Borough Council,
I have been informed to request the Care Plan and daily record book of my Uncle who passed away in November 2018 in Kenyon Rise, Bolton. I am his next of kin and have asked for the above documents at the time of his death, but unfortunately the staff and management directly involved with this case have abruptly stopped me at every angle they have given every excuse possible, and eventually told me to apply myself to the FOI.

As you wish to access information about a deceased person who has been
under the care of the Council, can we please ask that you submit your

The request will be processed under the Freedom of Information Act 2000
as Data Protection legislation (Data Protection Act 2018 and The General
Data Protection Regulation (GDPR)) only applies to living individuals.
However, as you will see below, before we action your request we will be
asking for information of a personal nature both of yourself and of the
deceased which we do not expect or want you to share on this website.
Additionally, it is also likely that any further information which may be
disclosed on action of this request may contain information of a sensitive
and personal nature which we are not willing to share on this forum.

 

To help us find and retrieve information for you, please state exactly
what information you require, and provide the following details of the
deceased:

o Details of the deceased (Name, Date of Birth, Date of Death, Last
known address)
o Confirmation that the person has died (Death Certificate or a Letter
granting Probate or Letters of Administration)
o Proof that you, as the applicant, are a Personal Representative
o Your identification as the person requesting the deceased’s personal
information, which must show your name and address.
o If it is known to us that there are more than one Personal
Representatives, you may be asked to provide a signed letter of
authority from any other Personal Representatives.
o If your request is through a solicitor who is acting for you then we
require a signed authority from them.

 

We will respond as soon as possible to this request once we have received
the requested documentation from you. If we do not receive the requested
evidence,  within two months of the date of this email, we will assume
that you have decided not to pursue this request for information and we
will close the request.
