I wish to make a Freedom of information request.

Please provide all emails about COVID-19 between this council and these care home providers:
- HC-One
- Four Seasons
- Barchester
- Bupa
- Care UK
- Renaissance

Please also provide all emails about COVID-19 between this council and all local authority-run care homes.

As a timeframe, please carry out a search between 1st February and 7th May.

On 1 April 2020, The Scottish Parliament passed emergency legislation in
response to the coronavirus Covid-19 pandemic. The [1]Coronavirus
(Scotland) Act 2020 contains a number of temporary amendments to the
operation of freedom of information (FOI) law in Scotland.  In summary,
these amendments will mean that, for a temporary period; the maximum
timescale within which Scottish public authorities must respond to
requests and reviews is extended from 20 to 60 working days.  

 

While Aberdeen City Council are prioritising resources to support
vulnerable citizens and essential services, we remain committed to provide
responses to FOI requests as soon as we can.  We will keep you updated
with the progress of your request. We thank you for your patience.

Dear Mr Everett,

 

We wrote to advise you that the deadline for your request for information
was 4 August 2020.

 

The Coronavirus (Scotland) Bill that extended the deadline to 60 working
days has now been repealed. This means that the original 20 working day
limit is restored for all requests.

 

The revised deadline for your request is now: 8 June 2020

Dear Mr Everett,

 

Thank you for your information request of 7 May 2020.  Aberdeen City
Council (ACC) has completed the necessary search for the information
requested. Our response is now detailed below.

 

Please provide all emails about COVID-19 between this council and these
care home providers:

 

- HC-One

- Four Seasons

- Barchester

- Bupa

- Care UK

- Renaissance

The local authority does not run care homes for older people and we are
unable to provide you with information on all emails about COVID-19
between ACC and the above care home providers, between the period 1
February to 7 May, as the cost of providing it has been calculated as
being in excess of the statutory maximum (£600).  To explain this, there
has been in excess of 1,000 emails sent to all care home providers from
Contracts at Aberdeen City Council.  These emails do not necessarily
record ‘Covid-19’ in the subject line and so all emails sent to providers
would need to be collated, read and  then those appropriate to be sent
will need to be sorted, filed and personal information redacted.  This
work has been calculated at 10 minutes per email, which equates to 166
hours, at the cost of £2,490 in total.

 

In order to comply with our obligations under the terms of Section 16 of
the FOISA, we hereby give notice that we are refusing your request under
the terms of Section 12 - Excessive Cost of Compliance - of the FOISA.

 

We would be happy to discuss ways in which you may refine your request, so
we can provide some information of interest to you within the maximum cost
limits.  Please do contact the Access to Information team, who will be
happy to advise you, if this is something you would like to pursue.

 

Please also provide all emails about COVID-19 between this council and all
local authority-run care homes.

As mentioned above, the local authority does not run care homes for older
people and therefore this information is not held by ACC.  In order to
comply with our obligations under the terms of Section 17 of the FOISA, we
hereby give notice that this information is not held by us. 

 

As a timeframe, please carry out a search between 1st February and 7th
May.
