Caravan thefts in Llwynhendy & Bynea area

Dyfed-Powys Police acknowledge receipt of your request which is being processed under the Freedom of Information Act 2000 however, prior to processing the request please would you clarify

i) Please provide further information as to the timeframe you require, can you please provide specific dates.
ii) When you refer to "what investigation", are you referring to the outcome of the investigation?
iii) with regards to the locations, are you requesting information for the specific towns of Llwynhendy & Bynea or do you mean the Carmarthenshire Division?

After receiving the clarification, your request will then be considered and you will receive a response within the statutory timescale of 20 working days as defined by the Freedom of Information Act 2000, subject to the information not being exempt or containing a reference to a third party. If we do not receive clarification from you within 40 working days, then your request will be closed.

There may be a fee payable for the retrieval, collation and provision of the information you request. If this is the case you will be informed and the 20 working day timescale will be suspended until we receive payment from you. If you chose not to make a payment then your request will remain unanswered.

Could you please let me know how many caravans were stolen between 1.1 2016 and end of November 2018 (or most recent figures available) could you let me know the specific dates of any reported thefts please?

With regard to investigation, what was the outcome, was any property recovered? Were any arrests or convictions made?
Was CCTV used to track any stolen vehicles on the public highway?

The area of interest is specifically the towns of Llwynhendy and Bynea

Thank you for your request for information dated and received by the
Freedom of Information Unit on 29^th November 2018 concerning caravan
thefts.

 

This request is being handled under the Freedom of Information Act 2000.

 

Dyfed-Powys Police can confirm that it does hold some of the information
covered by your request; however we believe that we need further time in
which to provide a full response to you.

 

We consider that the following exemption of the Freedom of Information Act
may apply to the information in part:

 

Section 30(1)(a)Investigations & Proceedings Conducted by Public
Authorities

 

(1) Section 30 Information held by a Public Authority is exempt
information if it has at any time been held by the authority for the
purposes of;

(a)  any investigation which the Public Authority has a duty to conduct
with a view to it being ascertained (i)whether a person should be charged
with an offence or (ii)whether a person charged with an offence is guilty
of it;

 

Section 30 is a class-based qualified exemption. This means that the
legislators when writing the legislation considered that the release of
such information under the Freedom of Information Act 2000 would cause
harm to the public authority or individual concerned. There is therefore
no requirement to carry out a HARM Test in respect of such information.
However there is a requirement to carry out a Public Interest Test in
order to establish whether the public interest in maintaining the
exemption may be outweighed by a wider public benefit in disclosure.

 

We now need further time in which to consider the public interest in
disclosing the information. We will endeavour to provide you with a
response as soon as possible and in any case by 15^th February 2019.
Should there be any further delay we will write to you accordingly.

handled, you can request a review by writing to the freedom of information

I write in connection with your request for information dated and received
in the Freedom of Information Unit at Dyfed-Powys Police on 29/11/18
regarding caravan thefts.

 

Your request for information has been handled under the Freedom of
Information Act 2000 and has now been considered.

 

Section 1 of the Freedom of Information Act 2000 places two duties on
public authorities. Unless exemptions apply, the first duty at Section
1(1) (a) is to confirm or deny whether the information specified in a
request is held. The second duty at Section 1(1) (b) is to disclose
information that has been confirmed as being held.

 

I can confirm that Dyfed-Powys Police does hold the information you have
requested. However we are also withholding some of that information since
we consider that the following exemptions apply

o Section 30(1)(a) – Investigations and proceedings conducted by public
authorities
o Section 40(2) – Personal Information

 

Where exemptions are relied upon section 17 of FOIA requires that we
provide the applicant with a notice which:

 

a) States that fact

b) Specifies the exemption(s) in question and

c) State (if that would not otherwise be apparent) why the exemption
applies

 

Please see the attached response document which details the release of
some of the information as well as the harm and public interest test
relative to the application of the exemption which in all the
circumstances of the case, the public interest in maintaining the
exemptions outweighs the public interest in disclosing the information.
