The Queens Hospital on Rom Valley Way has always had insufficent Car Parking to meet its needs

From April 2013 to 23 May 2016 The Old Ice rink Car park was available and relieved some of the congestion.

It would seem to be the height of incompetence or at the least does not seem credible that Councillors and or Council Officers had not considered the long term parking requirements for the area prior to the Ice rink Closure or what would happen if the Car Park closed permanently

Please therefore provide the following information under the FOI Act or any other appropriate Act

On what dates did any discussion, exchange of correspondance and or meeting in respect of Car Parking Provision on the Rom valley Ice rink Site take place between January 2010 to 1 May 2013, f

For each meeting, discussion or exchange of correspondance, please provide a copy of any record or an explanation as to why there no record was kept.

This request applies to all records (including electronic) held by the Council which show that Councillors and or Council Officers considered the long term Car Parking needs of visitors and staff to the Queens Hospital and includes emails (and deleted emails/records) from Councillors and Officers on their own accounts which relate to Council business

A search of the Council website reveals very few records (hence the request) , However if compliance with the request appears to require an unreasonable amount of time and or effort. Please confine the scope of the request to that which the Information Commissioner would consider reasonable , given the public interest in the lack of Car Parking provision for the Hospital and the amount of money the Council, receives from Car parking

If any record which ought to be disclosed contains commercally sensitive or privilaged information please redact where necessary.

On the 11 January 2017 we made a request which included the following

“On what dates did any discussion, exchange of
correspondence and or meeting in respect of Car Parking
Provision on the Rom valley Ice rink Site take place between
January 2010 to 1 May 2013.

For each meeting, discussion or exchange of correspondence,
please provide a copy of any record or an explanation as to
why there no record was kept.

emails (and deleted emails/records) from Councillors and

Your response, which was not within the time limits which the law allows. Provided only 12 pages of redacted emails. You failed to provide copies of any other documents including ones which are referred to within the emails you have provided.

Those emails also refer to other documents which have not been provided and which cannot be located on the Havering council web site.

Whilst it is appreciated that certain information is protected from disclosure by the Data protection Act. We are not satisfied that you have applied the DPA provisions correctly.
We therefore request a review of your response on the following grounds

A)The provisions of the Data Protection Act have been complied with correctly
B)Confirmation that there are no documents relating to the relevant Car Park between 17 November 2011 and 25 April 2013
C)That the provisions of section 77 of the Freedom of information Act and clause 19 of the Environment information regulations have not been breached.
D)Part of the 1 st email on page 10 is missing
E)The 3 rd email on page 11 (17 November @12.55) refers to meetings that were minuted and those documents have not been provided (even in redacted form)
F)The 3 rd email on page 11 refers to documents that have not been provided (even in redacted form)
G)It is clear form the inadequate redaction of the names on some of the emails, that there are other email strings which should properly be disclosed.

Given that you have already taken much longer that the law allows for a response that you will expedite this review and provide the missing documents and/or explanations and or responses

Thank you for your most recent correspondance.

The information provided and the manner in which the request has been dealt with does not appear to conform to the Havering Internal Review procedure or in the alternative the Havering Borough Councils three stage compliants process.

Furthermore;

The claim that the LBH BC does not have discloseable records of the information requested for the period between 17 November 2011 and 25 April 2013 is simply not credible. the LBH BC maintains an internal audit system of all electronic documents which is discloseable to the public. This audit trail therefore contains information which relates to our information request and should be produced along with the records and documents which that audit trail lists or records.

Of your response to d) - The provisions of section 77 of the FOI are not restricted to records that have been altered. we therefore require conformation that no discloseable records existed and if they existed and have been moved, where they have been moved to.

Of your response to e) - As part of the LBHBC audit procedures the whole email including the missing part is hekd within the LBH BC IT and managment system and should be produced.

Of your response to f) -The minutes of the meetings are discloseable information whether or not they are mentioned in the email or not. It is clear those meetings took place and it is not credible that records do not exist. Under the provisions of the FOI we are entitled to see copies of all relevent meeting notes, minutes , emails etc including records held of both Councillors and Officers email accounts.

Of your response to h) the names of Councillor Michael White and Council officer Simon Parkinson appear in documents relating to the subject matter of the FOI request during the period in question and which refer to further documents yet none of these documents have been produced. The public are entitled to see these documents if they are covered by the provisions of the FOI

Therefore please provide all documents relating to the subject matter of the original request for the stated time period which can be attributed to Councillor Whites role as a councillor and to Mr Simon Parkinsons role as a Council Officer. (

If any the aforementioned documents have been destroyed, alterered. removed or otherwise become unavailable to the public, please state who authorised the destruction, alteration, removal or unavailability and provide a copy of the Information technology Management system audit trail which shows when and how they were destroyed, altered, removed or otherwise became unavailable.

Dear Accessinfo / Ms V Taylor ,

We wish to complain about the failure of The London Borough of Havering to provide the information requested.

The Havering IT system logs show that electronic communications between Councillors and Officers in relation to the subject of our request during the period in question, exist in the audit logs and that the documents and information are as a result being deliberately withheld, supressed or have been destoyed.

The public are entitled to know how persons in Public Office have acted and the Transparency and Anti corruption policies of the London Borough of Havering should fully support this contention.

The ICO has issued a decision notice. dated 6 November 2017

The failure of the authority to deal with the request promptly and or correctly, was reported to the ICO. The ICO agreeed with the majority of the Requesters concerns, However the Requester felt that the LA had not made the required effort in searching for information and or produced all of the information which the public were entilted to see.

The Decision notice was appealed and a hearing took place on 3 September 2018.

Dear Gatehouse Trust

 

I write with regard to the amended order dated 11^th October 2018 made by
the First Tier Tribunal sitting at the Maidstone Magistrates Court on the
3^rd September 2018.

 

You will have noted that the order states requested dates for information
as being between January 2011 – 1 May 2013 which is incorrect.

 

The original request for information that was made by Gatehouse Trust on
the 17^th January 2017 asked the following:

 

On what dates did any discussion, exchange of correspondence and or
meeting in respect of Car Parking Provision on the Rom valley Ice rink
Site take place between January 2010 to 1 May 2013.

 

For  each meeting, discussion or exchange of correspondence,  please
provide a copy of any record or an explanation as to why there no record
was kept. 

 

This request applies to  all records (including electronic) held by the
Council  which show that  Councillors and or Council Officers considered
the long term Car Parking needs of visitors and staff to the Queens
Hospital  and  includes emails (and deleted emails/records) from
Councillors and Officers on their own accounts  which relate to Council
business

 

A search of the Council website reveals very few records (hence the
request) , However if compliance with the request appears to require an
unreasonable amount of time and or effort.  Please confine the scope of
the request to that which the Information Commissioner would consider
reasonable , given the public interest in the lack of Car Parking
provision for the Hospital and the amount of money the Council, receives
from Car parking.

 

The above request has been reviewed again and staff still in the councils
employ who were named on list attached to the Information Commissioners
letter dated 6^th November 2017 – (Ref: FS50669077) have searched their
email accounts for information relating to above request between the dates
referred to and I can advise that no additional information is held.

 

Information that may be contained within litigation documents would be
subject to the following exemptions:

 

Section 40 – Personal Information relating to a 3^rd party

 

Exemption not subject to the Public Interest Test

 

Section 42 – Legal Professional Privilege

 

Reasons to withhold

This applies to advice given by Lawyers, Legal Advisors & Barristers to
their clients of who have a general expectation that their conversations
and advice will remain confidential

 

Public Interest Test

Whilst releasing the requested information would promote openness and
transparency, there is a strong public interest in protecting the
confidentiality of communications between lawyers and their clients and as
such the public interest weighs in favour of withholding the information
