Dear Julie Whitehead in Customer Services,

Swindon Borough Council is breaching the FOI Act. A response to my FOI is currently very overdue.

Earlier requests for an update have gone unanswered. This is very unprofessional.

It is not without precedent, my previous FOI request was shoddily handled too. A failure to log my request properly onto the system was blamed as to why it had taken so long. Please can you ensure my original request has been logged correctly and that a response is on its way please. The treatment I am getting from SBC is simply not good enough.

Yours sincerely,

Magnus Ponsonby-Talbot

Dear Swindon Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Swindon Borough Council's handling of my FOI request 'Car parking'.

I am concerned about the length of time it took to get the information I requested, (nearly twice the length of time allowed by law without a PIT extension). I am also concerned that I got it only by pestering and therefore I'd like to confirm that the figures are indeed accurate. The formatting of the "total figure earned" suggests attention to detail is not strong in the FOI team.

It all leads me to believe that my FOI has not been handed properly

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/c...

Freedom of Information, Swindon Borough Council

Dear Magnus Ponsonby-Talbot,

Ref FOI002038 Freedom of Information Request for Review Complaint
FIR000016

As requested in your email below dated 30th September, I have reviewed how
your request was dealt with and the information that was sent to you in
response to your request.

In reviewing, I have noticed a small error within the formatting of the
following line within our response of 23/09/2019 “Total to the end of
March 2019 = £1,9247,597.28”, should have been shown as ‘Total to the end
of March 2019 = £19,247,597.28’.

I have seen evidence that your request was treated seriously and the
unfortunate delays were caused because of a need for senior specialist
individual staff involvement with your request, which necessitated waiting
for their return from annual leave. As a consequence, the response did
take longer than we would have preferred, and we are sorry for any
inconvenience this may have caused you.

Our aim is to complete all requests within the statutory deadline. Every
request we receive has an impact on individual workloads and this has to
be balanced against all the other Council responsibilities.

I have checked with the officers concerned and asked if there are any
further amendments necessary, but they have nothing to add.

Therefore I am content that your request was dealt with properly given the
resources available at the time.

This concludes the Council’s review process. If you are not content with
the outcome, you may apply to the Information Commissioner's Office for a
review.

Dear Mr Maskell,

Thank you for your (once prompted) speedy response.

Whilst I am content with the outcome of your review, I am concerned with parts of your response, namely the amount of time and resource allocated to, and by extension the priority Swindon Borough Council attach to transparency.

As such, I will be raising this matter with the ICO.

Yours sincerely,

Magnus Ponsonby-Talbot
