Dear Information Officer,

You will be aware by know that I have served exactly the same Freedom of Information Request on the PINS. My intention is to be transparent so I am informing you Mr R Carnaby sent me by email 22nd July 2015 in respect to complying with this request. Is not the same as the document supplied under compliance with the same request by HBC. These two documents are substantially different. There is 1911 differences consisting of 773 additions, and 311 deletions, 44 information in different places and 783 stylistic changes between these two pieces of supplied information see below. How can therefore both of these documents both be the original information authored by Richard E Hollox BA(Hons) BSc (Econ) MPhil (Lond) FRTPI FRICS when they are not even the same?

It is apparent from the document online on HBC website that it was authored by a kkulbert with the document title described as “DPD report HASTINGS final MODIFIED BY EMAIL 22-06-15” http://www.hastings.gov.uk/content/envir...

Your reluctance to provide a report from the Inspector only undermines the position that the Inspector authored a report as part of the REPORT ON THE EXAMINATION INTO THE HASTINGS
LOCAL PLAN DEVELOPMENT MANAGEMENT PLAN REVISED
PROPOSED SUBMISSION VERSION 10 MARCH – 22 APRIL 2014.
Surely this cannot be the case?

I have spoken to the ICO as the file provided by PINS as The document properties for this file you attached show that this file was edited for 18mins and created 22/04/2015 13:50 oddly it was last printed 26/10/2010 09:09. It also shows you Mr Stephen Carnaby also modified this file 14/05/2015. This document file you attached is still not consistent with being sourced from Richard E Hollox BA(Hons) BSc (Econ) MPhil (Lond) FRTPI FRICS the Inspector. I am quite aware of what the details of the correct files author properties should show.

Odd file dates in computer files are usually attributed to a touch process to electronically alter file dates on an electronic system.

The matter was referred for Internal Review with the PINS 23/07/2015.

I still have not recieved , seen or had sight of a signed copy of the Inspectors Report, this has not been provided. This can be sent as Microsoft Word digitally signed document or with signature from Inspector on the document in its orginal form not digitally scanned. I am beginning to believe that HBC has paid for services with tax payers money that they have not recieved. I do not understand why this is not being provided and is taking so long

Dear Mr Newbold
 
I refer to your recent correspondence in respect of the Development
Management Plan Inspectors report.
 
The Council has been in receipt of the Development Management Plan
Inspector's Report since the 29th May.  The Report was made publically
available as soon as was practically possible.  The document was made
available to view/download from the Council’s website on the 2nd June.  A
paper copy was also made available to view in the Council Community
Contact Centre (CCC).  The Report was received direct from the Planning
Inspectorate, the Council therefore has no reason to doubt the Report’s
authenticity.  Nor has this Report been changed by the Council other than
amending it specifically to meet Mr. Hollox’s request dated 21st June. 
This instruction was made via the Programme officer, and required the
Council to insert just ten words in to the Report to describe a specific
site.  This change is clearly explained on the Council’s website and in a
note appended to the paper copy in the CCC.
 
All of these details have been set out and explained in a recent letter
sent to you from the Planning Policy Team together with copies of the
relevant emails and the Report.  If you have any further queries as to the
authenticity of the Report I would advise that this is taken up with
Planning Inspectorate.

I have asked you if you hold a signed copy of the Report from Mr Hollox Public Inspector To the Hastings Local Plan Development Plan Revised Second Edition. You have not stated this in your comments. By signed I mean digitally or by hand . This has not been provided to me on request now for since teh 25th June when it was requested. I can confirm we have picked up further copies from Information Centre and these are also not signed or digitally signed.

I have asked you therefor if you do not hold this information i.e this signed Inspectors Report as you have not provided it since my original Request some eighty-one (81)days ago , then please state it is not Held as this would seem the case.

I have still not recieved a copy of this report digitally signed Inpectors Report

I understand you had a council meeting 23 September 2015. in regard this matter to approve these changes when you have not supplied a docment to show this document is held in within 80 days.

Your paperwork states
Councillor Chowney moved approval of the recommendations to the report, which was seconded by Councillor Poole.

RESOLVED (by 5 votes for, 0 against with 2 absentions) that:

1) Cabinet considered the Inspector’s recommendations and proposed main modifications (MM’s) to the plan, as attached at appendix A to the Assistant Director for Regeneration and Culture’s report;

2) Cabinet recommends to Council the incorporation of the Inspector’s 8 main modifications into the DMP;

3) Cabinet considered the main modifications as incorporated in the DMP together with all minor modifications and the policies map attached as Appendices B, Ci and Cii to this report and recommends that Council adopt the Hastings Development Management Plan;

4) Cabinet expresses its appreciation to all those staff responsible for the preparation of the plan and in particular officers from the Planning Policy team, and;

Minutes:

The Senior Planner presented the report of the Assistant Director of Regeneration and Culture on the outcome of the examination in public of the Hastings Development Management Plan (DMP) and the process and timescale for the adoption of the plan by the council.

In February 2014, the council had adopted the Hastings Planning Strategy, which identified the overarching objectives for sustainable development of homes and employment space within the Borough up to 2028. It was necessary for the council to adopt a DMP to provide a greater level of detail on its policies in respect of design, amenity, access, ground conditions, pollution, hazards and the protection of the historic and natural environment, which prospective planning applications will be assessed against. The DMP also allocated sites for residential and employment usage, and included specific policies relevant to the development of these sites.

The proposed DMP had been subject to an extensive public consultation, followed by an examination in public by an independent Inspector between October and December 2014. The examination in public comprised a series of formal hearing sessions, when those who had made representations on the Plan were able to attend and give evidence for the Inspector to consider. The final hearing session was held on 16 January 2015, and the Inspector then undertook site visits before drafting his final report.

The Inspector assessed the DMP to examine whether the preparation of the plan was sound and complied with the duty to co-operate and the relevant legal requirements. The Inspector found that the DMP submitted to the Secretary of State came close to achieving the right balance between the economic, social and environmental roles referred to the in the framework (NPPF). Accordingly, he recommended eight main modifications, to ensure the plan was sound and legally compliant.

The Inspector’s modifications had been incorporated in the revised DMP, which it was proposed to submit to Full Council for adoption at its meeting on 23 September 2015.

Councillor Chowney proposed an additional recommendation to thank the Inspector, Richard Hollox, for his efforts and to wish him a happy retirement.

Councillor Chowney moved approval of the recommendations to the report, which was seconded by Councillor Poole.

RESOLVED (by 5 votes for, 0 against with 2 absentions) that:

1) Cabinet considered the Inspector’s recommendations and proposed main modifications (MM’s) to the plan, as attached at appendix A to the Assistant Director for Regeneration and Culture’s report;

2) Cabinet recommends to Council the incorporation of the Inspector’s 8 main modifications into the DMP;

3) Cabinet considered the main modifications as incorporated in the DMP together with all minor modifications and the policies map attached as Appendices B, Ci and Cii to this report and recommends that Council adopt the Hastings Development Management Plan;

4) Cabinet expresses its appreciation to all those staff responsible for the preparation of the plan and in particular officers from the Planning Policy team, and;

Minutes:

The Director of Operational Services presented a report to inform members about work being undertaken by East Sussex, West Sussex and Surrey County Councils to develop proposals for a combined authority, within the context of devolution in England.

The government has placed an emphasis upon co-operation between public bodies across local areas, by developing combined authorities across public service providers. East Sussex County Council had led work to develop a devolution prospectus for the three counties around the two complimentary work streams of economic growth and enhanced productivity and public service transformation. The work streams identified in the prospectus incorporated proposals in respect of transport links, digital infrastructure, housing and actions to achieve and retain a highly skilled workforce. The prospectus did not currently include Brighton and Hove.

It was essential for the council to take an active role in ensuring that the new structure and programme paid attention to the particular social and economic conditions in Hastings and similar coastal towns. There was also a need to highlight the importance of sustainable growth and regeneration in areas currently outside the high wage /cost economy of much of the rest of the South East. The Chief Executive of East Sussex County Council had sought comments on the draft prospectus by 27 August 2015, to enable submission by 4 September 2015. The comments made by the Leader of the Council to the initial consultation had been appended to the Director of Operational Service’s report.

Councillor Chowney moved approval of the recommendations to the report, which was seconded by Councillor Hodges.

RESOLVED (unanimously) that:

1) Cabinet confirms its support for the comments attached as an appendix to the Director of Operational Service’ report, and;

2) The council should work to try and ensure that issues of economic and social inclusion form a significant part in the offer finally made to government around a future combined authority

The reason for this decision was:

To establish a platform on which the council’s participation in the devolution agenda can be based.

I am quite aware that Hastings Borough Council is obligated and required to make this Planning Inspectors Final Report available (the requirement for planning authority to make this available contained in Regulation 25 of the Town and Country Planning (local Planning)(England) Regulations 2012 (http://www.legisstlation.gov.uk/uksi/201...).

The document the Hastings Borough Council has placed on line authored by M Kerry Culbert who has been involved in the Development Management Plan Process since its inset. There is no digital signature attached to this Final Inspectors Report and this has a soft font signature created with Lucida calligraphy which is a free front to download on line (https://www.fontyukle.net/en/Lucida+Call...). This is therefore not the Inspectors Final Report and the Hastings Borough Council Duty and obligations under the Town and Country Planning Act have not been met. I believe this is a serious complaint which I wish some explanation for.

FER0590308 has provided a version of Inspectors Report , although this cannot be authenticated as being written by MRichard E Hollox BA(Hons) BSc(Econ) MPhil FRTPI . It is also noted that this document was written by Mr. Stephen Carnaby , PINS in just 3 mins which is absurd as it is a forty two page document. I understand ICO Mr Christopher Williams is to make a decision notice that PINS hold this document described above. This decision will make no reference to the authenticity of this document which still has not been provided. This has resulted in ICO Descision dated 5th October 2015 under Environmental Information Regulations 204(EIR)

It is apparant 1st October 2015 that the Planning Inspectorate has issued a statement on this site in regard to not holding tis report. I have been continualy told that Council has this report but cannot see why the Inspectorate does not .

Freedom of Information Request ref 15/353 – Can you please provide me the following document in respect to the DMP Process – Request For Review.
Subject Request Response from Planning Inspectorate:
As you are already aware, the local planning authority are required to make the Inspector's report publically available, and you are aware that thie report is already publically available on Hastings Borough Council website. I would also separately refer you to my email to you of 28 September 2015, which also provided you with a copy of the Inspector's report.

Whilst I note you require an 'authenticated version', there are no further 'authenticated' versions of the report that we hold.

I understand this Decission Notice will be on the ICO website in a week or so.

Further to this new information. I believe some explanation should be provided by the Council in regard to the persons who created the Hastings Borough Council Online version of this Inspectors Report as it is now clear it has not come from the Planning Inspectorate. Furthermore I believe the Council should make available publically the invoice and or PO in regard to the payment to the Planning Inspectorate.

As you can imagine this has come as a shock and I am struggling to make sense of correspondence from Council and Councillors.

I am attaching letter you sent me by email with attachments and my reply to your legal department as it is clear that you do not want to send me a genuine authenticatable Planning Inspectors Report in a timely fashion contrary to Regulation 25 and do not either wish to state it is not held. I feel I will have to place this matter with the Information Control Officer. I am very dismayed that you have taken this stance and not responded to my request for a meeting in August 2015 or responded to this request providing this information in over 126 days.
