Dear Mr Osborne,

Thank you for your FOI request which has been passed to me to handle.

You will know from your other requests there is a lot of legal material
that can get in the way and I want to avoid that if i can.

From what you ask what I can get for you is:

1) Figures for cab related assault
2) Figures for cab related sexual assault
3) Figures for cab related rape.

I cannot get figures on convictions data within the time the Act allows
me.

To help you as much as I can I could get you figures on:

4) Figures on the detection status of cab related sexual offences.
5) Figures on the number of People Proceeded Against for cab
related sexual offences.
6) Figures on how we proceeded against them(e.g. charge/ cautioned,
etc). This is the stage before going to court and being convicted.

If you say that you are happy for me to provide the above 4, 5 and 6
instead of convictions data I can get this out to you fairly soon.

I won't bore you with the details of the legal material but if you are not
happy with the above redefinition I will have to refuse the entire request
and not be able to give you anything which isn't very constructive.

Please can you get back to me as soon as possible confirming the
redefinition as i would much rather be able to let you have data than not.

I write in connection with your request for information which was received
by the Metropolitan Police Service (MPS) on 24/11/2010. I note you seek
access to the following information:

This letter is to inform you that it will not be possible to respond to
your request within the cost threshold. The reason for this being that we
did not hear back from you concerning our request to redefine the request
to something achievable. Taking your request in its original format means
we would have to attempt to obtain the convictions data from the systems
we have access to. That would involve downloading the crime references for
the cab related sexual offences. Then manually matching these with the
CRIS system to obtain the suspect and accused names behind these numbers,
also to obtain unique identifiers for the names e.g. DoB, ethnicity, age
(so to avoid matching to the wrong individual with the same name). All
these would have to be manually compared with the PNC database to confirm
if we hold the convictions data, and if we do, to retrieve it.

We estimate that the cost of complying with this request would exceed the
appropriate limit. The appropriate limit has been specified in regulations
and for agencies outside central Government; this is set at **450.00.
This represents the estimated cost of one person spending 18 hours [at a
rate of **25 per hour] in determining whether the MPS holds the
information, and locating, retrieving and extracting the information.

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice.

Section 17(5) of the Act provides:

(5) A public authority which, in relation to any request for information,
is relying on a claim that section 12 or 14 applies must, within the time
for complying with section 1(1), give the applicant a notice stating that
fact.

Section 12 of the Act provides:

(1) Section 1(1) does not oblige a public authority to comply with a
request for information if the authority estimates that the cost of
complying with the request would exceed the appropriate limit.

Under Section 16 (duty to assist) I offered you the chance to redefine
your request to something which was achievable within the time and cost
provisions of the Act. I have not heard back from you concerning this. If
you do wish to take me up on the offer of redefinition this will be logged
as a new and separate request.
