Dear Cherwell District Council,

Please can you provide me with the following information under the
Freedom Of Information Act 2000:-

The most up to date list you can obtain with;
(a) List all Commercial properties and their addresses.
(b) The names and addresses of the Rate payers referred to above
for each property and their correspondence address (if different
from the property address)
(c) The billing authority reference for each property
(d) The current liability payable for the year 2015/16.
(e) The date the rateable occupier first became liable for the
business rates
(f) Please also state which hereditament is currently receiving
I. Charitable rate relief (mandatory rate relief)
II. Discretionary rate relief
III. Empty property rate relief
IV. Listed building exemption
V. Retail Relief
VI Small Business Rate Relief
VII. Any other relief

Thank you for your e-mail dated 19/05/2015. 

 

The Council is dealing with your requests under the Freedom of Information
Act.  This means the Council has 20 working days to respond to your
request.  Unless the Council does not have the information or determines
that, if it has the information, it is not required to release it to you,
the Council should send you the information requested, or a notification
of the cost of supplying that information, by 17/06/2015

 

There are two circumstances in which you may be asked to pay for
information provided as a result of your request.

 

1.    If you are provided with any information as a result of your
request, you will be required to pay the Council's disbursements in
providing that information. 

Please note there is no limit on the amount you may be charged, although
you will not be charged at all if the disbursements amount to less than
£5.00.  Disbursements consist of any costs arising from:

 

•      Complying with your request for the information to be provided in a
particular format;

•      Reproducing the document;

•      Costs of postage or fax.

 

You will be notified of any disbursement costs once the Council is in a
position to provide the information requested and the Council will not
release the information until these costs have been paid.  You will have 3
months to pay the disbursement costs from the date you are notified of
these costs. 

 

2.    The Council may also determine that it is not obliged to release the
information because it will cost more than £450 to locate, retrieve and
extract the requested information.  If this is the case, the Council may
still offer to provide the information for the amount it will cost for it
to do this.  In this case you will be notified of the cost of this
information before it is supplied at which point you will have 3 months to
decide whether or not you wish to pay this cost. 

           

       You may also be required to pay disbursements on top of this
amount.

 

If the Council confirms it has the information but considers that it is
not required to release it, you will be given a written notification
detailing why the information is not being released.

Unfortunately, the Council has not been able to respond to your request
within the 20 day limit laid down by the Freedom of Information Act. The
delay is due to the Service Assurance Team, who hold the information you
requested, lacking resources.

In consideration of your request the Council has determined that, whilst
it holds information of the description specified in your request, some of
that information is exempt under the Act.  The Council considers that the
following exemptions apply to some of the information requested:

 

In accordance with Section 17 of the Act, the Council hereby gives notice
that the following exemptions apply to some the information requested:

 

S40(2) and (3) – Personal Data

This exemption is considered to apply because some of the information you
have requested is the personal data of a third party.  The Council
believes that if it were to provide you with this information, it would be
in breach of the Data Protection Act 1998.

 

The Council therefore proposes to supply you with only that information
which it considers it may legitimately release under the Freedom of
Information Act and any personal data has been redacted from the
information attached.
