Business and Property Courts deliberately confusing?

Response to this request is long overdue. By law, under all circumstances, Insolvency Rules Committee should have responded by now (details). You can complain by requesting an internal review.

Dear Insolvency Rules Committee,

Business and Property Courts deliberately confusing?

Why are the above so confusing for the average individual to understand is it so that they cannot tell which court or list they should be on?

Why are they no longer called the bankruptcy list and instead called insolvency and companies list?

What is to stop the county court hearing centres hearing bankruptcy cases when they are contested or tricking individuals into attending the wrong court or having their case put onto the wrong list?

What formation and policy do you hold that prevents miscarriages of injustice occurring especially for those that represent themselves or have to rely on lawyers that cannot be trusted.

What are the correct procedures that has to be followed by councils and the courts and what are the punishments when they ignore them and bring proceedings into the wrong level of court, normally the county court?

Do you check that the correct authorisation is held and where can the details of these individuals acting as judges and their authorisations be found, are these publicially available or are they also kept hidden.

What is in place to ensure that transparent services are bring provided?

The Insolvency Rules Committee's purpose is to consider amendments to the rules of insolvency following a review of legislation (you can find out more on our 'About Us' page here - https://www.gov.uk/government/organisati...).

Unfortunately, your questions relate to court procedure rather than a review of legislation, and, as such, I would recommend that you direct your enquiries to Her Majesty's Court and Tribunals Service (HMCTS) or the Ministry of Justice (MoJ) who will be in a better position to provide an answer.

Dear FOI,

Thank you for confirming that your agency has no say in ensuring that transparent services are supposed to be delivered, can you not review the legislation to ensure that the correct procedures must be followed, or are the HMCTS an Executive Agency and their agent "judges" free to ignore your recommendations?

If this is the case what is your purpose?
