Bus Lane Enforcement

Dear Bury Metropolitan Borough Council,

I am seeking information in regards to Bus Lane Enforcement in the
Bury area.

1. Under the FOI Act 2000, please can you supply me with details of
which Section of the Road Traffic Act or any other legislation
which makes it lawful for Bus Lane enforcement vehicles to park on
footpaths and other 'off road' locations.

2. Please supply me with all documentation held by the Council which
addresses the subject of parking on pavements by bus lane
enforcement vehicles, i.e. risk assessments, decision making
documents.

3. A list of all enforcement camera locations that are operating in
Bury’s bus lanes.

4. Number of fines issues to date and what cameras the fines took
place in the year 2017 unill today.

5. Breakdowns of monies generated from the bus lane cameras.
(For example - Employing the Civil Enforcement Officers cost, cost
to run and maintain the CCTV system) to date.

6. Has the driver got access to footage or personal data of vehicles passing the camera.

Request for Information - Freedom of Information Act 2000 (FOIA) - 11017

 

I write further to your e-mail received by the Council on 27^th June 2019
where you made the following request for information.

 

The Council’s response to your request is as follows;

 

Request; Which sections of the Traffic Act makes it lawful for bus lane
cctv vehicles to park on the footpath?

 

Response; Under Part 6 offences of Traffic Management Act 2004, Councils
can exercise their statutory powers and duties regarding enforcement.
Additionally all the bus lane enforcement bays in Bury have been
introduced following authorisation by the Secretary of State for Transport
under sections 64 & 65 of the Road Traffic Regulation Act 1984.

 

Request; Provide the documentation addressing the parking of the vehicle
on the footway

 

Response; The enforcement vehicle has exemptions in respect to the Traffic
Regulation Orders and Prohibitions in so long as the vehicle cannot be
reasonably parked elsewhere. We do not hold any documentation as only a
visual and verbal site discussion took place between Council Engineering
staff & senior staff from NSL.

 

Request; List the operating camera enforcement areas

 

Response; Manchester Road, Bury Old Road, Bolton Road, Bury New Road

 

Request; Number of pcns issued at each enforcement area from 2017 to date

 

Response; Manchester Road = 1,747; Bury Old Road = 1,260; Bolton Road =
3,454; Bury New Road = 929

 

Request; Breakdown of monies generated such as Enforcement Officer costs,
cctv maintenance;

 

Response; I do not understand this question as you mention income
generation and running costs in the same request. However the operating
costs for 2017/18 were £122,573 whereas the income was £101,092

 

Request; Has the driver access to footage or personal data of passing
vehicles?

 

Response; The operator only records vehicle that are in the bus lane. They
do not have access to those vehicle or driver details.

 

There are 2 documents on the Council website, bus lane cctv Code of
Practice and CCTV Traffic Enforcement: Protocols & Procedures which may be
of use.
