Good afternoon, Carl. I hope you are well. Please accept my felicitations for a happy and healthy 2019.

In response to a Freedom of Information request dated 22nd November 2018 to the Office of the Police, Fire & Crime Commissioner for North Yorkshire (OPFC-NY), pursuant to a newspaper article in the Scarborough News ( https://www.thescarboroughnews.co.uk/new... ) concerning sexual images and so-xcalled 'revenge porn', I have been referred to the NYPCP.

My request comprised two parts, the first of which I cite here only to provide context of the second part of my request. (This is not part of my request proper):

"1) Would you please confirm the total number of participants in your consultation, so that precise numerical values can be attributed to the cited percentages?

You are quoted as stating "The evidence is stark and irrefutable – the government, police and criminal justice system are collectively failing victims of revenge porn".

It has been suggested that the government, police and criminal justice system are collectively failing victims of several categories of unacceptable conduct."

The second part has been refused on grounds that the information is not held. I have been referred to the NYPCP for the information. Here is the second part of my request, which I now address to you under the terms of the FOIA 2000:

"2) Would you please provide such figures as you may hold on the total number of victims comprising the various sub-categories of victims (e.g. victims achieving successful prosecutions, victims who have not reported offences, etc) of bullying in the work place?"

In order to provide a report for publication in either the North Yorks Enquirer or Private Eye magazine (or both) that is accurate and fair, and given the topicality of the present scandal surrounding the NY-PFCC ( http://nyenquirer.uk/bullygan-scandal-ny... ), I would be grateful indeed if you find yourself able to provide a satisfactory response as soon as possible, for which I thank you in anticipation.

January 2019, which has been passed to the Police, Fire and Crime Panel
("the Panel") and has been shared with the Chair, Councillor Carl Les.

 

I note that your request to the Panel is as follows:

 

Would you please provide such figures as you may hold on the total number
of victims comprising the various sub-categories of victims (e.g. victims
achieving successful prosecutions, victims who have not reported offences,
etc) of bullying in the work place?

 

I note that this request is made within the context of a recent survey of
victims of revenge porn which was conducted by the Police, Fire and Crime
Commissioner (“the Commissioner”).

 

As this is a piece of work which has been commissioned and directed via
the Commissioner, the Panel has had no involvement in the survey, nor has
it received any report on this survey from the Commissioner.  Therefore,
under the terms of the Freedom of Information Act 2000 we are unable to
assist with this request as we do not hold the information that you
require.

 

I am unclear as to why you have been guided towards the Panel as an
appropriate source for this type of information by the Civil Disclosure
Unit and have raised this with the Commissioner's office.

 

I'm sorry that the Panel is unable to assist you further with your
request.  If you are dissatisfied with the response you have received from
the Panel, you may raise an appeal.  I attach our information governance
appeals document for your reference.

I appreciate your concern regarding the reason for me being referred to the Panel. Rather than impacting negatively on the Panel's resources by appealing for an Internal Review (which, in any case, is unlikely to elicit the requested information), I prefer to allow your enquiries to run their course, on the basis that you will keep me apprised of the response(s).

Dear Nigel,

 

Thank you for your correspondence of 25th January 2019.

 

As highlighted in my response to you of 17th January 2019, the Police,
Fire and Crime Panel does not hold the information you are seeking and as
such we are unable to assist you further with this request.

 

However, as I was unclear as to why you had been directed to the Panel for
this information, I highlighted this to the Commissioner's office on the
understanding that they may wish to consider their direction in this
respect and on the premiss that the Panel does not intervene or mediate in
individual correspondence matters.  However, having raised this issue I am
happy to share with you that I received the following message yesterday
from the office of the Commissioner's Chief Executive:

 

"[the Chief Executive has] spoken to the legal officers concerned with the
reply and can confirm that the response to section two states “You may
wish to contact the Police and Crime Panel for this type of information”. 
This was due to the interpretation of the question relating to bullying in
the work place.  After these discussions there is no further action
planned from NYP in relation to this FOI (980.2018-19)."

 

I'm sorry the Panel is unable to assist you further with your request. 
You have referenced potentially requesting an internal review of the way
the Panel has handled your request, which of course you may do using the
details provided in my previous response.  I hope this is helpful.

I can confirm that it is not my wish to pursue an Internal Review.

It was not my expectation, given the Commissioner's record, that the Office of the Police, Fire & Crime Commissioner would evince transparency, most especially on the subject of bullying in the workplace. There are occasions upon which silence tells its own story.
