information. The Trust has treated your request as a request for
information under the Freedom of Information Act 2000.

 

Your Request For Information:

 

Please can you provide any and all information held about the Broad Cut
Moorings on the Calder & Hebble Navigation, sited near Junction 39 of the
M1 motorway in Wakefield.

 

Please can you provide any and all information relating to the two lock
gates either side of the moorings, namely "Broad Cut Low" and "Broad Cut
Top".

 

Response:

 

I’m writing to confirm that while the Trust holds information on the
subject you have requested. I have to advise you that we will not be able
to answer your request without

exceeding the appropriate limit. This is because to locate, retrieve,
extract information in the scope of your request would involve at least
over 100+ hours of work.

 

Section 12 of the Freedom Of Information Act 2000 makes provision for
public authorities to refuse requests for information where the cost of
dealing with them would exceed the appropriate limit, Which for public
authorities is set at £450 with staff time calculated at £25 per hour in
line with the ICO guidance.

 

The Trust may be able to provide some information in scope of your request
if you reduce or refine your request to bring the cost of compliance under
the limit by requesting more specific information in regards to the
moorings for example requesting information in relation to changing the
mooring to a summer mooring or reducing the time scope of the request down
to information created in the last year.  

 

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of this email and should be sent

Dear Alan,

Thank you for contacting the Canal & River Trust with your request for information. We have treated your request as a request for information under the Environmental Information Regulation 2004.

Your Request:
In that case, please can you supply me with add documents or information relating to flood risk and management thereof for the section of canal from just above the 'Figure of Three Lock' to the 'Bottom Lock, Broad Cut Moorings' where the canal meets the river

Response:

Following receipt of your request the Canal & River Trust has conducted searches to locate any information held that is relevant to your request.

I can confirm, that the Canal & River Trust holds the information you have requested on this occasion, however we are unable to supply the requested information.

The exception(s) applicable to the information on this occasion are as follows.

Regulation 12 (5)(a) – Disclosure would adversely affect International Relations, Defence, National Security & Public Safety.

This exception requires the Canal & River Trust to conduct a public interest test before it can be relied upon, this has been set out below.

Factors Favouring Provision of Information
Section 12 (2) states that ‘A public authority shall apply a presumption in favour of disclosure’. Based on this, there is a public interest in disclosure of the request information as it would raise the Trust’s accountability and provide transparency in to the Trust’s operations.
Further, the Environmental Information Regulations 2004 promotes the general presumption of openness to promote accountability and transparency,

Factors Against Provision of Information
I am of the opinion that it is not in the public interest to disclose information relating to the flood risks in a specific area. To provide this information into the public domain would allow those minded to place public safety at risk the information relating to any vulnerabilities which could aide such an attempt. Public Safety is of paramount importance to the Trust and as such we will not release information which could place this at rick or expose any potential vulnerabilities.

There are two specific factors (as set out in the public interest guidance) which are of extreme prevalence to maintaining this exemption:
Likelihood of adverse effect - Information exposing the vulnerabilities of high-risk assets would be in the public domain posing a very real risk to public safety.  
Severity – The requested information contains details of the impact of canal breaches on people and property. This includes likelihood of flooding and even potential loss of life. Canal breaches unfortunately continue to present a major area of risk to the Trust.

Conclusion
I believe that, on balance, it is not in the public interest to release the information which you have requested on this occasion for the reasons stated above.

The Canal & River Trust provides you the right to request an Internal Review under its review procedure and in line with the Environmental Information Regulations 2004.
