What information is available to clarify for the Britannia Centre Car Park:
1) Who dictates policy issues and the rules that are applied (e.g. charge rates, charge concessions, blue badge accommodation etc.)?
2) Who (within local government) has responsibly for ensuring the rules are enforced?
3) Who manages the facility on a day to day basis (local authority, contractor etc.)? If a contractor,
a. who hold the contract?
b. What and how frequently does the contractor report on their activities to support the fees they levy.
4) What penalty measures are applied to infringement (fines, wheel clamps etc.), how can they be pursued within law and who would initiate a prosecution?
5) What data is collected in relation to the operation (no. tickets issued by reason, no. fines issues/appealed/collected etc.). Note I do not want the data itself at this stage, just a list of what it covers.
6) The annual financial position for the most recent 12m period – revenue by type, expenditure by type and profit/loss.

Surprising but nevertheless thank you for the response. Could you please just clarify:
1) Whether or not NCP owns the car park and if not with whom do they hold the contract?
2) That HBBC has no involvement whatsoever in the way the car park is managed or operated. This would mean that, for example, that NCP can charge whatever rates it chooses even if they are out of line with council policy and rates elsewhere in the town.

Your unhelpful response may be in line with the letter of the legislation but is most certainly not in line with its spirit. I would refer you to the ICO website where it is clear that public bodies are expected to be as helpful as possible.
I have not asked you for opinions etc., just for any written information you may have which is of course within the scope of the legislation. Dear Rose Cullingford,
I have reviewed the handling of your request and my findings are as follows; my colleague, Faye Biddles, was correct in that this car park is not owned by HBBC, so unfortunately we were unable to answer your FOI request. In her response of 15 January 2018, Ms Biddles stated that this information was not held and quoted guidelines published by the Information Commissioner as to why we cannot answer requests for information not held in hard copy by the council. As the guidelines are taken directly from the ICO, I do not agree that there was a breach of Section 16 of the Freedom of Information Act. At no time did Ms Biddles intend her response to be misread as unhelpful, and for this she apologises.
For clarity, the car park is operated by NCP who would have the financial and operational data you require. They are able to set their won charges regardless of the charges levied by the Borough Council in its car parks. May I suggest you contact them to gain the relevant information (contact details below):
