Dear Mr Parry,

Thank you for your email of 10/04/2018 where you informed us that your
preferred dates for information in relation to MA Construction (Brighton)
Limited are 2011-2015.

 

This specified period will exceed the cost limit. Section 12 of the
Freedom of Information Act 2000 makes provision for public authorities to
refuse requests for information where the cost of dealing with them would
exceed the appropriate cost limit. This is £450 for the Council and this
equates to 18 hours work. We estimate that it will take us in excess of
the applicable time limit to determine the appropriate material and
locate, retrieve and extract the information in reference to your request.
Therefore, your request will not be processed further.

 

In order to assist and to indicate how much information could be provided
within the cost limit, please note that each year within the period
2011-2015 will exceed the cost limit. It is more likely that a three-six
month period within one year will be below the cost limit. The information
that the Council holds consists mainly of job sheets and emails.

Thank you for your email of 8th May 2018 where you requested the following
information:

 

MA CONSTRUCTION (BRIGHTON) LIMITED Perhaps you could limit the information
to any material held associated with the Internal Audit Report (Ref:
A118/001/2016) published 10.12.15 together with all information covering
the period April 2014 - August 2015. Could you also provide information as
to the date when the company was first used as a sub contractor and the
date when it ceased to be a sub contractor for the Council/Mears
Partnership

 

 

As mentioned in our response on 08/05/2018, a period of one year will
exceed the cost limit and a period of three-six months is more likely to
be below the cost limit. The above request still exceeds the costs limit.
Section 12 of the Freedom of Information Act 2000 makes provision for
public authorities to refuse requests for information where the cost of
dealing with them would exceed the appropriate cost limit. This is £450
for the Council and this equates to 18 hours work. We estimate that it
will take us in excess of the applicable time limit to determine the
appropriate material and locate, retrieve and extract the information in
reference to your request. Therefore, your request will not be processed
further.

 

In order to assist and to indicate how much information could be provided
within the cost limit (subject to any relevant redaction), please see
below the following information:

 

It will take the Council '

 

a.194 hours to retrieve all the job sheets that relate to MA Construction
for the period 2014-2015. For 2014, the hours are 118 and for 2015, the
hours are 76. This is based on it taking five minutes per job sheet.

b. 7 hours to retrieve all the information associated with the Internal
Audit Report published on 10 December 2015. Please therefore note that the
first part of your request: 'any material held associated with the
Internal Audit Report (Ref: A118/001/2016) published 10.12.15' would be
within the cost limit. Locating information within 'all information
covering the period April 2014-August 2015' will exceed the cost limit.

c. Emails covering the period April 2014- August 2015 will take the
Council in excess of 11.75 hours of hours to locate. This is made up of
fifteen minutes per person for the period in 2014 (of which there are 12
people who need to check their emails) and 34 minutes for each person for
the period in 2015 (of which there are 14 people who would need to check
their emails). The search strategy has been based on a random sampling
exercise.

Furthermore, it took the Council 3.5 hours to locate the information in
your request for information dated 14 April 2018. This has been taken into
account as the request is for similar information and within the relevant
period of time.

I am writing to request an internal review of Brighton and Hove City Council's handling of my FOI request 'Brighton & Hove City Council and MA Construction (Brighton) Ltd'. (Reference: 682033)

I find it extremely worrying that obfuscation and delaying tactics are being employed to prevent the release of any information regarding the fraud or "overcharging" associated with MA Construction Ltd.

I asked (10 April 2018) " Could you please advise for which periods of time you are able to provide details of information held within the limits as determined under Section 12" in appreciation of your desire to reduce costs.

One would also assume that information requested is already in an accessible form as it has presumably been extracted and examined by Internal Audit.

In the interests of Justice as well as transparency and the law, please provide what information you can including a description of that you are refusing to become public knowledge under Section 12.

Many thanks for your email of 31 August. I have today received the "Internal Review" as a result of your intervention (copied below).

I find it completely unsatisfactory as it is clear from the information provided that the information held is easily accessible from the Internal Audit Report on the fraud it is alleged MA Construction Ltd perpetuated.

I believe the "internal Review" is purely a 'ticking the box' exercise to meet the requirements of the ICO in order to prevent release of the information to the public record prior to a special meeting of BHCC Housing Committee to discuss the contract under which the fraud was carried out. The meeting is scheduled for 26 September 2018.

Please accept our apologies for the delay. The data was received by the
Information Governance Team on 21/01/2019 but due to an administrative
oversight this has only just been identified.
 
We are attaching the data to this email. The following cover note was
provided by the team who provided the data.
 
"The information attached consists of 6 spreadsheets provided to Internal
Audit by BHCC Financial Services in September 2015. The data contained is
from a Mears System, MCM. It is contains all payment data for
subcontractors from the April 2010 to the date of the request, including
MA Construction. They are very large documents which contain domestic
address and job descriptions for each entry. These have been redacted, as
shown in grey shading . These columns have been removed as they contained
information including addresses of individual council tenants and in the
job description column (in some cases) the name, phone number or contact
details etc of some tenants or other persons."
 
Please note that due to the size of the files it will be necessary to send
these as attachments over several emails.
