1) I would like to request all internal correspondence and communications which mentions, or refers to, the Brexit Party.
2) I would also like to request all external correspondence and communications between the Council and the Brexit Party.
I would like to receive this information in an electronic format. If you feel that a substantive response to this request is not possible within a reasonable time frame, I would be grateful if you could contact me and provide assistance as to how I can refine the request. I am writing in respect of your enquiry dated 6th May 2019.
The information you requested is held by the Council on behalf of the Electoral Registration Officer. Returning Officers, Electoral Registration Officers and their deputies are not public bodies subject to the Freedom of Information Act. The functions of a Returning Officer or Electoral Registration Officer are separate from the functions of the authority which employs the Returning Officer or Electoral Registration Officer.
There is no statutory obligation for a Returning Officer or Electoral Registration Officer to provide you with information or supply answers to your questions, but in the interests of transparency the Electoral Registration Officer will consider your request and respond to you directly. In order to facilitate this, I have copied the elections team into this email correspondence.

I refer to your request under the Freedom of Information Act 2000.
In relation to the function of registering electors, the registration of
electors is governed by the Representation of the People Act 1983 as
amended. Under Section 8 of the Act, the council must appoint an officer
of the council to be the registration officer for any constituency
coterminous with or situated in the council’s area. Susan Priest is the
appointed Electoral Registration Officer for Folkestone & Hythe District
Council. The appointment as Electoral Registration Officer is a separate
appointment. Although appointed by the Council, the Electoral
Registration Officer’s responsibilities and duties are personal. An
example of this is that the register of electors is deemed to be the
property of the Electoral Registration Officer, not the local authority.
The Electoral Registration Officer does not carry out the duties on behalf
of the local authority but in their own personal capacity. A list of
public bodies and local authorities that are subject to the provisions of
the Freedom of Information Act is included in Schedule 1 to the Freedom of
Information Act 2000. A list of public bodies that are subject to the

As you will see, the Freedom of Information Act does not list any person
appointed under the Representation of the People Act 1983. The Electoral
Registration Officer is not subject to the provisions of the Freedom of
Information Act.
As such, the Council is not is not obliged to respond to this request.
