I refer to your request for information, made under the Freedom of
Information Act 2000 (the Act). 

 

Under the Act, public authorities have two duties to individuals
requesting information: firstly, to confirm whether or not they hold the
information requested, and secondly to provide a copy of that information
unless one or more of the exemptions under the Act apply.

 

Your request

 

I note that the board papers for Ofqual are available on its website up
until September 2019 but no later.

 

Please provide papers submitted to the board for all dates since then,

Our response

We have searched our records and I can confirm that Ofqual holds some
information of the type that you have requested.

 

Exemption

Section 22 of the Act provides an exemption for information that
is intended to be published in the future. Information is exempt if, at
the time the public authority receives a request for it, the public
authority holds the requested information and it intends the information
to be published at some future date, whether that date is determined or
not. Also, that in all circumstances it is reasonable to withhold the
information until its planned publication.  

 

Releasing the information, at this time, may affect our ability to meet
our statutory objective to secure public confidence in
qualifications. Releasing the information as a whole, rather than
piecemeal through freedom of information requests, will mean that all who
may rely on the information will have complete information.

 

Public Interest Test (PIT)

 

The exemption in section 22 of the Act is a qualified
exemption and subject to the public interest test. Ofqual has not
yet considered whether in all the circumstances of the case, the public
interest in withholding the information outweighs the public interest in
disclosing the information. We will now be undertaking this exercise and
will inform you of our conclusions in due course.
