Dear Mr Bell,

I write with regard to your request.

In respect of this, an authority can extend the time for compliance to allow it more time to respond to complex or voluminous requests, or in order to consider the balance of public interest, under s. 10(3).

The Trust in this instance, unfortunately, requires the additional twenty working days to consider, among other things, the balance of the public interest. The Trust’s proposed reliance on section 36 – disclosure would prejudice the effective conduct of public affairs – requires a complex weighting exercise to be undertaken in order to determine whether the disclosure of that which is sought ought to be made.

Section 36 states that information is exempt where, in the reasonable opinion of a qualified person, disclosure would or would be likely to prejudice the effective conduct of public affairs. The Trust is now considering its reliance on section 36(b)(ii); that is to say the position that disclosure would, or would be likely to, inhibit the free and frank exchange of views.

The Information Commissioner accepts that a public authority, such as CNWL, needs a safe space to develop ideas and proposals, debate, and reach decisions away from external interference and distraction. Can it be said that disclosure would inhibit the receipt of future representations at a Board of Director’s meeting? The Trust is, undoubtedly, entitled to a free space to explore, say, the novel and innovative, while discussing strategy and corporate risks, too. In turn, therefore, it seems the Trust would, likely, be victim to a ‘chilling effect’ should the information sought, in this instance, be disclosed; such a disclosure would inhibit free and frank discussions in the future, and the loss of candour may impact upon any individual’s willingness to consult and respond freely without fear of further dissemination.

I wish to consider the exemption and, crucially, the balance of the public interest weighting exercise.

I will be in touch as promptly as possible but, in any event, by 05 September 2018.

Thank you for your response to my request for an internal review of the decision to withhold the information requested.

I would like to ask you to reconsider the decision to withhold all of the information and not to consider redacting those parts of the report which remain sensitive or where it is in the public interest that the information is kept confidential.

Having not seen the information it is difficult for me to make a judgement as to whether all of the contents requested meet the relevant test.

Could I ask you to review the response within the next 20 days and let me have a response which is clearly marked FINAL RESPONSE from the Trust so that I can then refer the matter to the ICO for thire view.
