I am writing to request an internal review of Natural Resources Body for Wales's handling of my FOI request 'Biomass UK No.2 Limited Barry Energy Production Facility - Decision Document'.

as i understand it there are two reasons given for refusing disclosure.

with regard to the issue of internal documents i note the advice from the Commissioner includes:

Essentially, an internal communication is a communication that
stays within one public authority. Once a communication has
been sent to someone outside the authority, it will generally no
longer be internal.

if, in the present case, drafts were discussed eg with the owners of the site or their agents then the drafts are no longer internal documents and should be disclosed.

with regard to the other reason, this relates to:

Regulation 12(4)(d) –
Information in course of completion

The argument in favour of disclosure is built into the reason given for non-disclosure. The report is no longer in course of completion. It is completed. this issue no longer applies.

In the circumstances i ask that the matter is reviewed, my points considered and hopefully disclosure made.

September 2022.  You registered your dissatisfaction with Natural
Resources Wales' response to your request ATI-23791a dated 13 September
2022. 

  

I will be undertaking an internal review under Regulations 11(1) and 11(2)
of the Environmental Information Regulations (EIR) 2004. This review will
consider the information that was considered for release under the
Environmental Information Regulations. This regulation states that if you
feel that a public authority has not dealt with a request for
environmental information properly, you can complain and ask us to
reconsider the response. 

  

I aim to respond as soon as possible and no later than 40 working days
from when we received the representations. I will contact you as soon as
possible if I need to clarify your request.

However, I do not follow why my review request falls into the 40 days bracket rather than the usual 20 days.

Could you explain the circumstances that lead to an assumption that the review is either so complicated or raises issues which require such detailed consideration that the maximum time is required.

We are discussing a very limited amount of paperwork with what I believe to be simple representations on my part.

The usual period of 20 days is all but expired at the time when I was sent the update. If the problem is that it was over-looked I would appreciate it if it could now be escalated to allow a reply within 20 days.
