Dear Department for Business, Energy and Industrial Strategy,

In a statement published 24 November 2020 (link below) the Scottish & UK Governments stated:

"After exploring all options, both the UK and Scottish Governments have concluded that there is currently no legal route to provide further financial support to BiFab in its current form."

Please provide the following:

(1) All information about BiFab that was used as the basis for forming the decision.
(2) A copy of documents setting out all the options examined.

Please explain how the conclusion was formed by the governments without the involvement of BiFab or its parent company.

I am not, at this stage, seeking a copy of the legal advice.

Thank you for responding to my FOI request “BiFab Financial Support”. Unfortunately, the response is unsatisfactory and therefore, I am requesting an internal review.

If the statement below was made by the UK Government, then information must ALREADY BE COLLATED in order to form the conclusion in the statement. As a result, there should be no cost implications and the information can be provided with ease. (I have used capital letters as the WDTK system does not allow other forms of emphasis).

Alleged UK & Scottish Government Statement: “After exploring all options, both the UK and Scottish Governments have concluded that there is currently no legal route to provide further financial support to BiFab in its current form.”

If the statement above is false and therefore was not made by the UK Government then please state that. This would be a reason for not holding the information requested.
